بَابُ مَا يُكْرَهُ مِنَ الذَّبِيحَةِ فِي الذَّكَاةِ
Chapter on what is disliked regarding slaughtered animals
Hadith 1035
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ أَبِي مُرَّةَ مَوْلَى عَقِيلِ بْنِ أَبِي طَالِبٍ: أَنَّهُ سَأَلَ أَبَا هُرَيْرَةَ ، عَنْ شَاةٍ ذُبِحَتْ، فَتَحَرَّكَ بَعْضُهَا، " فَأَمَرَهُ أَنْ يَأْكُلَهَا " . ثُمَّ ثُمَّ سَأَلَ عَنْ ذَلِكَ زَيْدَ بْنَ ثَابِتٍ ، فَقَالَ: " إِنَّ الْمَيْتَةَ لَتَتَحَرَّكُ "، وَنَهَاهُ عَنْ ذَلِكَ . وَسُئِلَ مَالِك، عَنْ شَاةٍ تَرَدَّتْ، فَتَكَسَّرَتْ، فَأَدْرَكَهَا صَاحِبُهَا، فَذَبَحَهَا، فَسَالَ الدَّمُ مِنْهَا وَلَمْ تَتَحَرَّكْ، فَقَالَ مَالِكٌ: إِذَا كَانَ ذَبَحَهَا وَنَفَسُهَا يَجْرِي وَهِيَ تَطْرِفُ، فَلْيَأْكُلْهَا
Abu Murrah asked Sayyiduna Abu Hurairah (may Allah be pleased with him) that when a goat was slaughtered, it moved a little; Sayyiduna Abu Hurairah (may Allah be pleased with him) permitted eating it. Then Abu Murrah asked Sayyiduna Zayd bin Thabit (may Allah be pleased with him), who said: A dead animal also moves, and he forbade eating it.
Imam Malik (may Allah have mercy on him) was asked: If a goat fell from above and its legs and arms broke, and seeing this condition, the owner slaughtered it, and at the time of slaughter blood flowed but it did not move? Imam Malik (may Allah have mercy on him) replied that if blood flowed at the time of slaughter and its eye kept moving, then eat it.
