Hadith 1021
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ كَانَ يَقُولُ :
" مَنْ حَلَفَ بِيَمِينٍ فَوَكَّدَهَا، ثُمَّ حَنِثَ فَعَلَيْهِ عِتْقُ رَقَبَةٍ أَوْ كِسْوَةُ عَشَرَةِ مَسَاكِينَ، وَمَنْ حَلَفَ بِيَمِينٍ فَلَمْ يُؤَكِّدْهَا، ثُمَّ حَنِثَ فَعَلَيْهِ إِطْعَامُ عَشَرَةِ مَسَاكِينَ لِكُلِّ مِسْكِينٍ مُدٌّ مِنْ حِنْطَةٍ، فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ "
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say: Whoever swears an oath and then firmly maintains it, then breaks the oath, must free a slave or feed ten needy people. And whoever swears an oath and does not firmly maintain it, then breaks the oath, must feed ten needy people, giving each needy person one mudd of wheat. If he is not able to do so, then he must fast for three days.
Hadith 1022
عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّهُ قَالَ : أَدْرَكْتُ النَّاسَ وَهُمْ إِذَا أَعْطَوْا فِي كَفَّارَةِ الْيَمِينِ، أَعْطَوْا مُدًّا مِنْ حِنْطَةٍ بِالْمُدِّ الْأَصْغَرِ، وَرَأَوْا ذَلِكَ مُجْزِئًا عَنْهُمْ. ¤
Sulayman bin Yasar said that I saw people, when they would give the expiation for an oath, they used to give each poor person one mudd of wheat with the smaller mudd, and they considered that sufficient.
Hadith 1022B1
قَالَ مَالِكٌ : أَحْسَنُ مَا سَمِعْتُ فِي الَّذِي يُكَفِّرُ عَنْ يَمِينِهِ بِالْكِسْوَةِ. أَنَّهُ إِنْ كَسَا الرِّجَالَ، كَسَاهُمْ ثَوْبًا ثَوْبًا. وَإِنْ كَسَا النِّسَاءَ كَسَاهُنَّ ثَوْبَيْنِ ثَوْبَيْنِ. دِرْعًا وَخِمَارًا. وَذَلِكَ أَدْنَى مَا يُجْزِئُ كُلًّا فِي صَلَاتِهِ.
Imam Malik, may Allah have mercy on him, said: Whoever gives clothing to the poor as expiation for an oath, if he gives to poor men, giving one garment to each is sufficient, and if he gives to women, he should give two garments: a shirt and a head covering, which is called a khimar, because prayer is not valid with less than this.
Hadith 1023
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ

عَبْدِ اللَّهِ بْنِ عُمَرَ " أَنَّهُ كَانَ
يُكَفِّرُ عَنْ يَمِينِهِ بِإِطْعَامِ عَشَرَةِ مَسَاكِينَ لِكُلِّ مِسْكِينٍ مُدٌّ مِنْ حِنْطَةٍ، وَكَانَ يَعْتِقُ الْمِرَارَ إِذَا وَكَّدَ الْيَمِينَ "
When Abdullah bin Umar (may Allah be pleased with them both) would give the expiation for his oath, he would feed ten needy people, and he would give each needy person one mudd of wheat, and when he would swear the same oath multiple times, he would free as many slaves.
