بَابُ مَا جَاءَ فِي الْغُلُولِ
Chapter on What is Reported Regarding Misappropriation of War Booty
Hadith 980
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ عَبْدِ رَبِّهِ بْنِ سَعِيدٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ صَدَرَ مِنْ حُنَيْنٍ، وَهُوَ يُرِيدُ الْجِعِرَّانَةَ، سَأَلَهُ النَّاسُ : حَتَّى دَنَتْ بِهِ نَاقَتُهُ مِنْ شَجَرَةٍ، فَتَشَبَّكَتْ بِرِدَائِهِ حَتَّى نَزَعَتْهُ عَنْ ظَهْرِهِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " رُدُّوا عَلَيَّ رِدَائِي، أَتَخَافُونَ أَنْ لَا أَقْسِمَ بَيْنَكُمْ مَا أَفَاءَ اللَّهُ عَلَيْكُمْ ؟ وَالَّذِي نَفْسِي بِيَدِهِ، لَوْ أَفَاءَ اللَّهُ عَلَيْكُمْ مِثْلَ سَمُرَ تِهَامَةَ نَعَمًا، لَقَسَمْتُهُ بَيْنَكُمْ، ثُمَّ لَا تَجِدُونِي بَخِيلًا، وَلَا جَبَانًا، وَلَا كَذَّابًا "، فَلَمَّا نَزَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَامَ فِي النَّاسِ فَقَالَ : " أَدُّوا الْخَيَّاطَ وَالْمِخْيَطَ فَإِنَّ الْغُلُولَ عَارٌ وَنَارٌ، وَشَنَارٌ عَلَى أَهْلِهِ يَوْمَ الْقِيَامَةِ "، قَالَ : ثُمَّ تَنَاوَلَ مِنَ الْأَرْضِ، وَبَرَةً مِنْ بَعِيرٍ، أَوْ شَيْئًا، ثُمَّ قَالَ : " وَالَّذِي نَفْسِي بِيَدِهِ مَا لِي مِمَّا أَفَاءَ اللَّهُ عَلَيْكُمْ، وَلَا مِثْلُ هَذِهِ إِلَّا الْخُمُسُ وَالْخُمُسُ مَرْدُودٌ عَلَيْكُمْ "
It is narrated from Amr bin Shu'aib that when the Messenger of Allah, peace and blessings be upon him, returned from Hunayn and intended to go to Ji'ranah, people began to ask from him, so that the camel of the Messenger of Allah, peace and blessings be upon him, went towards a thorny tree and the thorns got caught in his cloak, and his cloak slipped off his blessed back. Then the Messenger of Allah, peace and blessings be upon him, said: "Give me my cloak. Do you think that I will not distribute to you that which Allah has given you? By Him in Whose hand is my soul! If Allah were to give you as many camels as there are trees in Tihamah, I would distribute them among you, and then you would not find me to be miserly, nor cowardly, nor a liar."
Then when the Messenger of Allah, peace and blessings be upon him, dismounted, he stood among the people and said: "If anyone has taken a thread or a needle, bring it too, for stealing from the spoils of war is a disgrace in this world, and fire, and a shame on the Day of Resurrection." Then he picked up a tuft of hair from the ground, either of a camel or a goat, and said: "By Him in Whose hand is my soul! Of the wealth that Allah the Pure has given you, not even this much is mine, except for the fifth part, and that too is for you."
Then when the Messenger of Allah, peace and blessings be upon him, dismounted, he stood among the people and said: "If anyone has taken a thread or a needle, bring it too, for stealing from the spoils of war is a disgrace in this world, and fire, and a shame on the Day of Resurrection." Then he picked up a tuft of hair from the ground, either of a camel or a goat, and said: "By Him in Whose hand is my soul! Of the wealth that Allah the Pure has given you, not even this much is mine, except for the fifth part, and that too is for you."
Hadith 981
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ ، أَنَّ زَيْدَ بْنَ خَالِدٍ الْجُهَنِيَّ ، قَالَ : تُوُفِّيَ رَجُلٌ يَوْمَ حُنَيْنٍ، وَإِنَّهُمْ ذَكَرُوهُ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَزَعَمَ زَيْدٌ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " صَلُّوا عَلَى صَاحِبِكُمْ "، فَتَغَيَّرَتْ وُجُوهُ النَّاسِ لِذَلِكَ، فَزَعَمَ زَيْدٌ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " إِنَّ صَاحِبَكُمْ قَدْ غَلَّ فِي سَبِيلِ اللَّهِ " قَالَ : فَفَتَحْنَا مَتَاعَهُ، فَوَجَدْنَا خَرَزَاتٍ مِنْ خَرَزِ يَهُودَ مَا تُسَاوِينَ دِرْهَمَيْنِ
Sayyiduna Zayd bin Khalid al-Juhani (may Allah be pleased with him) said: A man died in the battle of Hunayn, so it was mentioned to the Messenger of Allah (peace and blessings be upon him). He (peace and blessings be upon him) said: "Offer the prayer over your companion." The faces of the people turned pale, then he (peace and blessings be upon him) said: "This man committed theft from the spoils of war." Sayyiduna Zayd (may Allah be pleased with him) said: We opened this man's belongings and found a few beads belonging to the Jews, which were not even worth two dirhams.
Hadith 982
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ عَبْدِ اللَّهِ بْنِ الْمُغِيرَةِ بْنِ أَبِي بُرْدَةَ الْكِنَانِيِّ ، أَنَّهُ بَلَغَهُ : أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَتَى النَّاسَ فِي قَبَائِلِهِمْ، يَدْعُو لَهُمْ، وَأَنَّهُ تَرَكَ قَبِيلَةً مِنَ الْقَبَائِلِ، قَالَ : وَإِنَّ الْقَبِيلَةَ وَجَدُوا فِي بَرْدَعَةِ رَجُلٍ مِنْهُمْ عِقْدَ جَزْعٍ غُلُولًا فَأَتَاهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَكَبَّرَ عَلَيْهِمْ كَمَا يُكَبِّرُ عَلَى الْمَيِّتِ "
It is narrated from Abdullah bin Mughira that the Messenger of Allah, peace and blessings be upon him, came to the groups of people and prayed for all the groups except for one group, because in that group there was a person under whose bedding a stolen necklace was found. When the Messenger of Allah, peace and blessings be upon him, came to that group, he said the takbeer as is said over a funeral.
Hadith 983
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ ، عَنْ أَبِي الْغَيْثِ سَالِمٍ مَوْلَى ابْنِ مُطِيعٍ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : خَرَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حُنَيْنٍ، فَلَمْ نَغْنَمْ ذَهَبًا، وَلَا وَرِقًا إِلَّا الْأَمْوَالَ الثِّيَابَ، وَالْمَتَاعَ، قَالَ : فَأَهْدَى رِفَاعَةُ بْنُ زَيْدٍ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غُلَامًا أَسْوَدَ، يُقَالُ لَهُ : مِدْعَمٌ، فَوَجَّهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى وَادِي الْقُرَى، حَتَّى إِذَا كُنَّا بِوَادِي الْقُرَى بَيْنَمَا مِدْعَمٌ يَحُطُّ رَحْلَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ جَاءَهُ سَهْمٌ عَائِرٌ، فَأَصَابَهُ فَقَتَلَهُ، فَقَالَ النَّاسُ : هَنِيئًا لَهُ الْجَنَّةُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " كَلَّا، وَالَّذِي نَفْسِي بِيَدِهِ، إِنَّ الشَّمْلَةَ الَّتِي أَخَذَ يَوْمَ خَيْبَرَ مِنَ الْمَغَانِمِ، لَمْ تُصِبْهَا الْمَقَاسِمُ لَتَشْتَعِلُ عَلَيْهِ نَارًا "، قَالَ : فَلَمَّا سَمِعَ النَّاسُ ذَلِكَ جَاءَ رَجُلٌ بِشِرَاكٍ، أَوْ شِرَاكَيْنِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " شِرَاكٌ أَوْ شِرَاكَانِ مِنْ نَارٍ "
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that we set out with the Messenger of Allah, peace and blessings be upon him, in the year of Khaybar. We did not obtain gold or silver as spoils, but rather we received clothes and goods. And Rifa’ah bin Zaid gifted a black slave to the Messenger of Allah, peace and blessings be upon him, whose name was Mid’am. So the Messenger of Allah, peace and blessings be upon him, set out towards Wadi al-Qura. When we reached Wadi al-Qura, Mid’am was unloading the saddle of the Prophet’s camel, when suddenly a stray arrow struck him, and he died. The people said: Congratulations to him for Paradise. The Messenger of Allah, peace and blessings be upon him, said: Not at all, by the One in Whose hand is my soul! The blanket he took from the spoils of Hunayn before its distribution is now burning upon him as fire. When the people heard this, a man came and brought one or two straps, and the Prophet, peace and blessings be upon him, said: This strap or these two straps are also from the fire.
Hadith 984
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَنَّهُ بَلَغَهُ، عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ ، أَنَّهُ قَالَ : " مَا ظَهَرَ الْغُلُولُ فِي قَوْمٍ قَطُّ، إِلَّا أُلْقِيَ فِي قُلُوبِهِمُ الرُّعْبُ، وَلَا فَشَا الزِّنَا فِي قَوْمٍ قَطُّ إِلَّا كَثُرَ فِيهِمُ الْمَوْتُ، وَلَا نَقَصَ قَوْمٌ الْمِكْيَالَ، وَالْمِيزَانَ إِلَّا قُطِعَ عَنْهُمُ الرِّزْقُ، وَلَا حَكَمَ قَوْمٌ بِغَيْرِ الْحَقِّ، إِلَّا فَشَا فِيهِمُ الدَّمُ، وَلَا خَتَرَ قَوْمٌ بِالْعَهْدِ إِلَّا سَلَّطَ اللَّهُ عَلَيْهِمُ الْعَدُوّ "
Abdullah bin Abbas (may Allah be pleased with them both) said: The people who steal from the spoils of war, their hearts become weak; and the people among whom adultery becomes widespread, death also becomes widespread among them; and the people who cheat in weights and measures, their sustenance is cut off; and the people who judge unjustly, bloodshed increases among them; and the people who break their covenants, their enemies prevail over them.
