بَابُ الْقَسْمِ لِلْخَيْلِ فِي الْغَزْو
Chapter on Distribution for Horses in Battle
Hadith 979
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّهُ قَالَ : بَلَغَنِي أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ، كَانَ يَقُولُ : " لِلْفَرَسِ سَهْمَانِ وَلِلرَّجُلِ سَهْمٌ " . قَالَ مَالِك : وَلَمْ أَزَلْ أَسْمَعُ ذَلِكَ .
Imam Malik, may Allah have mercy on him, said: Hazrat Umar bin Abdul Aziz, may Allah have mercy on him, said: The horse has two shares, and the man has one share. Imam Malik, may Allah have mercy on him, said: I have always heard it like this.
Hadith 979B1
وَسُئِلَ مَالِك، عَنْ رَجُلٍ يَحْضُرُ بِأَفْرَاسٍ كَثِيرَةٍ، فَهَلْ يُقْسَمُ لَهَا كُلِّهَا ؟ فَقَالَ : لَمْ أَسْمَعْ بِذَلِكَ، وَلَا أَرَى أَنْ يُقْسَمَ إِلَّا لِفَرَسٍ وَاحِدٍ الَّذِي يُقَاتِلُ عَلَيْهِ
Imam Malik (may Allah have mercy on him) was asked: If a person brings many horses, will all the horses receive a share? He replied: No, only the horse on which he rides and fights will receive a share.
Hadith 979B2
. قَالَ مَالِك : لَا أَرَى الْبَرَاذِينَ، وَالْهُجُنَ إِلَّا مِنَ الْخَيْلِ، لِأَنَّ اللَّهَ تَبَارَكَ وَتَعَالَى قَالَ فِي كِتَابِهِ : وَالْخَيْلَ وَالْبِغَالَ وَالْحَمِيرَ لِتَرْكَبُوهَا وَزِينَةً سورة النحل آية 8، وَقَالَ عَزَّ وَجَلَّ : وَأَعِدُّوا لَهُمْ مَا اسْتَطَعْتُمْ مِنْ قُوَّةٍ وَمِنْ رِبَاطِ الْخَيْلِ تُرْهِبُونَ بِهِ عَدُوَّ اللَّهِ وَعَدُوَّكُمْ سورة الأنفال آية 60 فَأَنَا أَرَى الْبَرَاذِينَ وَالْهُجُنَ مِنَ الْخَيْلِ إِذَا أَجَازَهَا الْوَالِي . وَقَدْ قَالَ سَعِيدُ بْنُ الْمُسَيِّبِ وَسُئِلَ، عَنِ الْبَرَاذِينِ، هَلْ فِيهَا مِنْ صَدَقَةٍ ؟ فَقَالَ : " وَهَلْ فِي الْخَيْلِ مِنْ صَدَقَةٍ ؟ "
Imam Malik, may Allah have mercy on him, said: In my view, Turki and Mujannis are also included among horses, because Allah the Exalted has said: "We created horses, mules, and donkeys for you to ride." And Allah the Exalted has said: "Prepare against them (the disbelievers) whatever you are able of power and of steeds of war, by which you may terrify the enemy of Allah and your enemy." So in my view, Turki and Mujannis will be counted among horses when the ruler accepts them. Someone asked Hazrat Sa'id bin al-Musayyib whether there is zakat on Turki horses? He replied: Is there zakat on horses at all?
