Hadith 940
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
عَبْدِ الْكَرِيمِ بْنِ مَالِكٍ الْجَزَرِيِّ ، عَنْ
عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى ، عَنْ
كَعْبِ بْنِ عُجْرَةَ ، أَنَّهُ كَانَ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُحْرِمًا، فَآذَاهُ الْقَمْلُ فِي رَأْسِهِ، فَأَمَرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَحْلِقَ رَأْسَهُ، وَقَالَ :
" صُمْ ثَلَاثَةَ أَيَّامٍ أَوْ أَطْعِمْ سِتَّةَ مَسَاكِينَ مُدَّيْنِ مُدَّيْنِ لِكُلِّ إِنْسَانٍ، أَوِ انْسُكْ بِشَاةٍ أَيَّ ذَلِكَ فَعَلْتَ أَجْزَأَ عَنْكَ "
It is narrated from Sayyiduna Ka'b bin 'Ujrah, may Allah be pleased with him, that he was with the Messenger of Allah, peace and blessings be upon him, in the state of Ihram, and lice infested his head. So the Messenger of Allah, peace and blessings be upon him, ordered him to shave his head and said: Fast for three days, or feed six needy people two mudd of food each, or slaughter a sheep. Whichever of these he does will suffice.
Hadith 941
حَدَّثَنِي، عَنْ مَالِك، عَنْ
حُمَيْدِ بْنِ قَيْسٍ ، عَنْ
مُجَاهِدٍ أَبِي الْحَجَّاجِ ، عَنْ
ابْنِ أَبِي لَيْلَى ، عَنْ
كَعْبِ بْنِ عُجْرَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَهُ : " لَعَلَّكَ آذَاكَ هَوَامُّكَ " فَقُلْتُ : نَعَمْ، يَا رَسُولَ اللَّهِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" احْلِقْ رَأْسَكَ، وَصُمْ ثَلَاثَةَ أَيَّامٍ أَوْ أَطْعِمْ سِتَّةَ مَسَاكِينَ، أَوِ انْسُكْ بِشَاةٍ "
It is narrated from Sayyiduna Ka'b bin Ujrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Perhaps lice are troubling you?" He replied: "Yes, O Messenger of Allah!" The Prophet (peace and blessings be upon him) said: "Shave your head, and fast for three days, or feed six needy people, or sacrifice a goat."
Hadith 942
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
عَطَاءِ بْنِ عَبْدِ اللَّهِ الْخُرَاسَانِيِّ ، أَنَّهُ قَالَ : حَدَّثَنِي
شَيْخٌ بِسُوقِ الْبُرَمِ، بِالْكُوفَةِ، عَنْ
كَعْبِ بْنِ عُجْرَةَ ، أَنَّهُ قَالَ : جَاءَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَنَا أَنْفُخُ تَحْتَ قِدْرٍ لِأَصْحَابِي، وَقَدِ امْتَلَأَ رَأْسِي، وَلِحْيَتِي قَمْلًا، فَأَخَذَ بِجَبْهَتِي، ثُمَّ قَالَ :
" احْلِقْ هَذَا الشَّعَرَ، وَصُمْ ثَلَاثَةَ أَيَّامٍ، أَوْ أَطْعِمْ سِتَّةَ مَسَاكِينَ " وَقَدْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلِمَ أَنَّهُ لَيْسَ عِنْدِي مَا أَنْسُكُ بِهِ .
It is narrated from Sayyiduna Ka'b bin Ujrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) came to me while I was blowing on a pot for my companions, and my head and beard were filled with lice. The Prophet (peace and blessings be upon him) held my forehead and said: "Shave these hairs and observe three fasts, or feed six needy people." And the Messenger of Allah (peace and blessings be upon him) knew that I did not have anything for sacrifice.
Hadith 942B1
قَالَ مَالِك فِي فِدْيَةِ الْأَذَى : إِنَّ الْأَمْرَ فِيهِ أَنَّ أَحَدًا لَا يَفْتَدِي حَتَّى يَفْعَلَ مَا يُوجِبُ عَلَيْهِ الْفِدْيَةَ، وَإِنَّ الْكَفَّارَةَ إِنَّمَا تَكُونُ بَعْدَ وُجُوبِهَا عَلَى صَاحِبِهَا، وَأَنَّهُ يَضَعُ فِدْيَتَهُ حَيْثُ مَا شَاءَ، النُّسُكَ، أَوِ الصِّيَامَ، أَوِ الصَّدَقَةَ بِمَكَّةَ، أَوْ بِغَيْرِهَا مِنَ الْبِلَادِ .
Imam Malik, may Allah have mercy on him, said: No person should give the compensation for «أذي» unless he commits a fault, because committing a fault makes expiation obligatory, and he has the choice to give the compensation by sacrifice, or by fasting, or by charity, whether in Mecca or in any other city.
Hadith 942B2
قَالَ مَالِك : لَا يَصْلُحُ لِلْمُحْرِمِ أَنْ يَنْتِفَ مِنْ شَعَرِهِ شَيْئًا، وَلَا يَحْلِقَهُ، وَلَا يُقَصِّرَهُ حَتَّى يَحِلَّ إِلَّا أَنْ يُصِيبَهُ أَذًى فِي رَأْسِهِ، فَعَلَيْهِ فِدْيَةٌ، كَمَا أَمَرَهُ اللَّهُ تَعَالَى، وَلَا يَصْلُحُ لَهُ أَنْ يُقَلِّمَ أَظْفَارَهُ، وَلَا يَقْتُلَ قَمْلَةً، وَلَا يَطْرَحَهَا مِنْ رَأْسِهِ إِلَى الْأَرْضِ، وَلَا مِنْ جِلْدِهِ، وَلَا مِنْ ثَوْبِهِ فَإِنْ طَرَحَهَا الْمُحْرِمُ مِنْ جِلْدِهِ، أَوْ مِنْ ثَوْبِهِ، فَلْيُطْعِمْ حَفْنَةً مِنْ طَعَامٍ
Imam Malik, may Allah have mercy on him, said: It is not permissible for any Muhrim to pluck, shave, or shorten his hair until he has exited the state of Ihram, except in the case where there is harm to his head, then a fidya will be obligatory, as Allah, Glorified and Exalted is He, has commanded. And it is not permissible for a Muhrim to cut his nails, kill lice, remove lice from his head and throw them on the ground, or remove lice from his body or clothes. If he does so, he should give a handful of grain in charity for the sake of Allah.
Hadith 942B3
قَالَ مَالِك : مَنْ نَتَفَ شَعَرًا مِنْ أَنْفِهِ، أَوْ مِنْ إِبْطِهِ، أَوِ اطَّلَى جَسَدَهُ بِنُورَةٍ، أَوْ يَحْلِقُ عَنْ شَجَّةٍ فِي رَأْسِهِ لِضَرُورَةٍ، أَوْ يَحْلِقُ قَفَاهُ لِمَوْضِعِ الْمَحَاجِمِ وَهُوَ مُحْرِمٌ نَاسِيًا، أَوْ جَاهِلًا إِنَّ مَنْ فَعَلَ شَيْئًا مِنْ ذَلِكَ، فَعَلَيْهِ الْفِدْيَةُ فِي ذَلِكَ كُلِّهِ، وَلَا يَنْبَغِي لَهُ أَنْ يَحْلِقَ مَوْضِعَ الْمَحَاجِمِ .
Imam Malik, may Allah have mercy on him, said: Whoever plucks the hair of his nose, or his armpits, or applies depilatory to his body, or has a wound on his head and shaves his head out of necessity, or shaves the hair of his nape for cupping while in the state of ihram, if he does any of these things out of forgetfulness or ignorance, then in all these cases, he must offer a fidya (compensation). And it is not permissible for a person in ihram to shave the place for cupping.
Hadith 942B4
قَالَ مَالِك : وَمَنْ جَهِلَ فَحَلَقَ رَأْسَهُ قَبْلَ أَنْ يَرْمِيَ الْجَمْرَةَ افْتَدَى
Imam Malik, may Allah have mercy on him, said: Whoever shaves his head before throwing the pebbles out of ignorance must offer a fidya (compensation).
