Hadith 934
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
أَبِي الزُّبَيْرِ ، " أَنَّ
عُمَرَ بْنَ الْخَطَّابِ " قَضَى فِي الضَّبُعِ بِكَبْشٍ، وَفِي الْغَزَالِ بِعَنْزٍ، وَفِي الْأَرْنَبِ بِعَنَاقٍ، وَفِي الْيَرْبُوعِ بِجَفْرَةٍ "
It is narrated from Abu Zubair Makki that Sayyiduna Umar bin Khattab (may Allah be pleased with him) ordered: For killing a badger, the compensation is a ram; for a deer, a goat; for a rabbit, a one-year-old kid of a goat; and for a wild rat, a four-month-old kid of a goat.
Hadith 935
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
عَبْدِ الْمَلِكِ بْنِ قُرَيْرٍ ، عَنْ
مُحَمَّدِ بْنِ سِيرِينَ ، أَنَّ رَجُلًا جَاءَ إِلَى عُمَرَ بْنِ الْخَطَّابِ، فَقَالَ : إِنِّي أَجْرَيْتُ أَنَا وَصَاحِبٌ لِي فَرَسَيْنِ نَسْتَبِقُ إِلَى ثُغْرَةِ ثَنِيَّةٍ، فَأَصَبْنَا ظَبْيًا وَنَحْنُ مُحْرِمَانِ فَمَاذَا تَرَى ؟ فَقَالَ
عُمَرُ لِرَجُلٍ إِلَى جَنْبِهِ : " تَعَالَ حَتَّى أَحْكُمَ أَنَا وَأَنْتَ "، قَالَ : فَحَكَمَا عَلَيْهِ بِعَنْزٍ فَوَلَّى الرَّجُلُ، وَهُوَ يَقُولُ : هَذَا أَمِيرُ الْمُؤْمِنِينَ، لَا يَسْتَطِيعُ أَنْ يَحْكُمَ فِي ظَبْيٍ حَتَّى دَعَا رَجُلًا، يَحْكُمُ مَعَهُ، فَسَمِعَ عُمَرُ قَوْلَ الرَّجُلِ، فَدَعَاهُ فَسَأَلَهُ : " هَلْ تَقْرَأُ سُورَةَ الْمَائِدَةِ ؟ " قَالَ : لَا، قَالَ : " فَهَلْ تَعْرِفُ هَذَا الرَّجُلَ الَّذِي حَكَمَ مَعِي ؟ " فَقَالَ : لَا، فَقَالَ : " لَوْ أَخْبَرْتَنِي أَنَّكَ تَقْرَأُ سُورَةَ الْمَائِدَةِ لَأَوْجَعْتُكَ ضَرْبًا "، ثُمَّ قَالَ : " إِنَّ
اللَّهَ تَبَارَكَ وَتَعَالَى يَقُولُ فِي كِتَابِهِ : يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ هَدْيًا بَالِغَ الْكَعْبَةِ سورة المائدة آية 95 وَهَذَا عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ "
It is narrated from Muhammad bin Sirin that a man came to Sayyiduna Umar bin Khattab (may Allah be pleased with him) and said: I and my companion released our horses in a narrow valley, and we hunted a deer, and both of us were in the state of ihram. Sayyiduna Umar (may Allah be pleased with him) called a person who was sitting beside him and said: Come, let us both give a ruling together. So both of them jointly ruled for a goat. That man turned away and said: This is the Commander of the Faithful, he could not decide alone about a deer until he called another person to join him. Sayyiduna Umar (may Allah be pleased with him) heard this, so he called him and said: Have you read Surah Al-Ma'idah? He replied: No. Sayyiduna Umar (may Allah be pleased with him) said: Do you know the person who gave the ruling with me? He said: No. Sayyiduna Umar (may Allah be pleased with him) said: If you had said that you had read Surah Al-Ma'idah, I would have beaten you. Then he said: Allah Almighty says in His Book: "Let two just men among you judge concerning the penalty; the offering should be brought to the Ka'bah." And this person is Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him).
Hadith 936
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، أَنَّ
أَبَاهُ ، كَانَ يَقُولُ :
" فِي الْبَقَرَةِ مِنَ الْوَحْشِ بَقَرَةٌ، وَفِي الشَّاةِ مِنَ الظِّبَاءِ شَاةٌ "
It is narrated from Hisham bin Urwah that his father, Hazrat Urwah, used to say that for a nilgai (blue bull) one cow is obligatory, and for a deer one goat is obligatory.
Hadith 937
It is narrated from Sa'id bin al-Musayyib, he used to say: When a pigeon of Makkah is killed, a goat becomes obligatory.
Hadith 937B1
وَقَالَ مَالِك فِي الرَّجُلِ مِنْ أَهْلِ مَكَّةَ يُحْرِمُ بِالْحَجِّ أَوِ الْعُمْرَةِ، وَفِي بَيْتِهِ فِرَاخٌ مِنْ حَمَامِ مَكَّةَ، فَيُغْلَقُ عَلَيْهَا فَتَمُوتُ، فَقَالَ : أَرَى بِأَنْ يَفْدِيَ ذَلِكَ عَنْ كُلِّ فَرْخٍ بِشَاةٍ
Imam Malik, may Allah have mercy on him, said that if a person who lives in Makkah puts on the Ihram for Hajj or Umrah, and there is a nest of pigeon chicks in his house, and he closes the mouth of the nest and the chicks die, then for each chick he must give one goat.
Hadith 937B2
قَالَ مَالِك : لَمْ أَزَلْ أَسْمَعُ أَنَّ فِي النَّعَامَةِ إِذَا قَتَلَهَا الْمُحْرِمُ بَدَنَةً
Imam Malik, may Allah have mercy on him, said: I have always heard that when an ostrich is killed by a muhrim, then a camel becomes obligatory.
Hadith 937B3
قَالَ مَالِك : أَرَى أَنَّ فِي بَيْضَةِ النَّعَامَةِ عُشْرَ ثَمَنِ الْبَدَنَةِ، كَمَا يَكُونُ فِي جَنِينِ الْحُرَّةِ غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ، وَقِيمَةُ الْغُرَّةِ خَمْسُونَ دِينَارًا وَذَلِكَ عُشْرُ دِيَةِ أُمِّهِ .
Imam Malik, may Allah have mercy on him, said: In the case of an ostrich egg, one-tenth of the blood money for a camel is required, just as if someone kills the unborn child in the womb of a free woman, a slave man or woman must be given, whose value is fifty dinars, and fifty dinars is one-tenth of the total blood money.
Hadith 937B4
قَالَ مَالِك : وَكُلُّ شَيْءٍ مِنَ النُّسُورِ، أَوِ الْعِقْبَانِ، أَوِ الْبُزَاةِ، أَوِ الرَّخَمِ، فَإِنَّهُ صَيْدٌ يُودَى، كَمَا يُودَى الصَّيْدُ، إِذَا قَتَلَهُ الْمُحْرِمُ
Imam Malik, may Allah have mercy on him, said: The vulture, the eagle, and the rakhm—all of these are game; if someone kills them, compensation will be required.
Hadith 937B5
قَالَ مَالِك : وَكُلُّ شَيْءٍ فُدِيَ فَفِي صِغَارِهِ مِثْلُ مَا يَكُونُ فِي كِبَارِهِ، وَإِنَّمَا مَثَلُ ذَلِكَ مَثَلُ دِيَةِ الْحُرِّ الصَّغِيرِ وَالْكَبِيرِ فَهُمَا بِمَنْزِلَةٍ وَاحِدَةٍ سَوَاءٌ
Imam Malik, may Allah have mercy on him, said: The compensation for an animal remains the same as its prescribed recompense, whether the animal is small or large, just as the blood money for a minor and an adult is equal. That is, the compensation for a small deer is also one goat, and the compensation for a large deer is also one goat, just as if someone kills an adult man, the blood money is the same, and if someone kills a boy, the blood money is also the same.
