Hadith 920
It is narrated from Hazrat Asim bin Adi that the Messenger of Allah, peace and blessings be upon him, permitted the camel owners to spend the night and stay anywhere except Mina. They should perform the stoning (rami) on the Day of Sacrifice (Yawm al-Nahr), then on the second or third day, both, and if they stay, then also perform the stoning on the fourth day.
Hadith 921
It is narrated from Hazrat Ata bin Abi Rabah that in the earliest times (that is, in the era of the Messenger of Allah, peace be upon him), the camel herder was permitted to perform the stoning at night.
Hadith 921B1
قَالَ مَالِك : تَفْسِيرُ الْحَدِيثِ الَّذِي أَرْخَصَ فِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِرِعَاءِ الْإِبِلِ فِي تَأْخِيرِ رَمْيِ الْجِمَارِ، فِيمَا نُرَى وَاللَّهُ أَعْلَمُ أَنَّهُمْ يَرْمُونَ يَوْمَ النَّحْرِ، فَإِذَا مَضَى الْيَوْمُ الَّذِي يَلِي يَوْمَ النَّحْرِ، رَمَوْا مِنَ الْغَدِ وَذَلِكَ يَوْمُ النَّفْرِ الْأَوَّلِ، فَيَرْمُونَ لِلْيَوْمِ الَّذِي مَضَى، ثُمَّ يَرْمُونَ لِيَوْمِهِمْ ذَلِكَ، لِأَنَّهُ لَا يَقْضِي أَحَدٌ شَيْئًا، حَتَّى يَجِبَ عَلَيْهِ، فَإِذَا وَجَبَ عَلَيْهِ، وَمَضَى كَانَ الْقَضَاءُ بَعْدَ ذَلِكَ، فَإِنْ بَدَا لَهُمُ النَّفْرُ، فَقَدْ فَرَغُوا، وَإِنْ أَقَامُوا إِلَى الْغَدِ، رَمَوْا مَعَ النَّاسِ يَوْمَ النَّفْرِ الْآخِرِ، وَنَفَرُوا
Imam Malik, may Allah have mercy on him, said that the hadith of Asim bin Adi, in which the Messenger of Allah, peace and blessings be upon him, granted concession to camel herders regarding the stoning of the Jamarat, its explanation is that they should perform the stoning on the Day of Sacrifice (Yawm al-Nahr), then when the eleventh day passes, on the twelfth day they should perform the stoning for the eleventh and also for the twelfth. Then, if they depart on the twelfth, that is better; otherwise, if they stay until the thirteenth, they should perform the stoning with the people and then depart.
Hadith 922
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
أَبِي بَكْرِ بْنِ نَافِعٍ ، عَنْ
أَبِيهِ ، أَنَّ ابْنَةَ أَخٍ لِصَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ، نُفِسَتْ بِالْمُزْدَلِفَةِ، فَتَخَلَّفَتْ هِيَ وَصَفِيَّةُ حَتَّى أَتَتَا مِنًى بَعْدَ أَنْ غَرَبَتِ الشَّمْسُ مِنْ يَوْمِ النَّحْرِ، فَأَمَرَهُمَا
عَبْدُ اللَّهِ بْنُ عُمَرَ " أَنْ
تَرْمِيَا الْجَمْرَةَ حِينَ أَتَتَا، وَلَمْ يَرَ عَلَيْهِمَا شَيْئًا " .
It is narrated from Nafi that the niece of Safiyyah bint Abi Ubaid experienced postnatal bleeding at Muzdalifah, so she and Safiyyah stayed there until they reached Mina, and the sun had set on the Day of Sacrifice. Then Abdullah bin Umar (may Allah be pleased with them both) instructed both of them to throw the pebbles when they arrived at Mina, and he did not impose any penalty upon them.
Hadith 922B1
قَالَ يَحْيَى : سُئِلَ مَالِك، عَمَّنْ نَسِيَ جَمْرَةً مِنَ الْجِمَارِ فِي بَعْضِ أَيَّامِ مِنًى حَتَّى يُمْسِيَ ؟ قَالَ : لِيَرْمِ أَيَّ سَاعَةٍ ذَكَرَ مِنْ لَيْلٍ أَوْ نَهَارٍ، كَمَا يُصَلِّي الصَّلَاةَ إِذَا نَسِيَهَا، ثُمَّ ذَكَرَهَا لَيْلًا أَوْ نَهَارًا، فَإِنْ كَانَ ذَلِكَ بَعْدَ مَا صَدَرَ، وَهُوَ بِمَكَّةَ أَوْ بَعْدَمَا يَخْرُجُ مِنْهَا فَعَلَيْهِ الْهَدْيُ وَاجِبٌ
Imam Malik, may Allah have mercy on him, was asked: What if a person forgets to perform the stoning (rami) at any of the jamarat on any of the days of Mina, until evening comes? He replied: Whenever he remembers, whether by night or by day, he should perform the stoning, just as with prayer—if someone forgets and then remembers by night or by day, he should perform it. However, if he has reached Mecca and then remembers, or if he remembers after leaving Mina, then a sacrifice (hady) becomes obligatory.
