بَابُ هَدْيِ مَنْ أَصَابَ أَهْلَهُ قَبْلَ أَنْ يُفِيضَ
Sacrifice for One Who Had Intercourse Before Completing the Rituals
Hadith 862
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ أَبِي الزُّبَيْرِ الْمَكِّيِّ ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ وَقَعَ بِأَهْلِهِ وَهُوَ بِمِنًى قَبْلَ أَنْ يُفِيضَ " فَأَمَرَهُ أَنْ يَنْحَرَ بَدَنَةً "
Abdullah bin Abbas (may Allah be pleased with both of them) was asked about a man who had intercourse with his wife while he was in Mina, before performing the Tawaf al-Ziyarah. So Abdullah bin Abbas (may Allah be pleased with both of them) ordered him to slaughter a camel.
Hadith 863
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ ، عَنْ عِكْرِمَةَ مَوْلَى ابْنِ عَبَّاسٍ، قَالَ : لَا أَظُنُّهُ إِلَّا عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ ، أَنَّهُ قَالَ : " الَّذِي يُصِيبُ أَهْلَهُ قَبْلَ أَنْ يُفِيضَ يَعْتَمِرُ وَيُهْدِي "
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: Whoever has intercourse with his wife before performing the Tawaf al-Ziyarah should perform an 'Umrah and offer a sacrifice.
Hadith 864
وَحَدَّثَنِي، عَنْ مَالِك، أَنَّهُ سَمِعَ رَبِيعَةَ بْنَ أَبِي عَبْدِ الرَّحْمَنِ ، يَقُولُ فِي ذَلِكَ مِثْلَ قَوْلِ عِكْرِمَةَ، عَنْ ابْنِ عَبَّاسٍ . ¤
Hazrat Rabi’ah bin Abi Abdur Rahman has also said the same.
Hadith 864B1
قَالَ مَالِك : وَذَلِكَ أَحَبُّ مَا سَمِعْتُ إِلَيَّ فِي ذَلِكَ .
Imam Malik, may Allah have mercy on him, said: I like this narration very much.
Hadith 864B2
قَالَ يَحْيَى : وَسُئِلَ مَالِك، عَنْ رَجُلٍ نَسِيَ الْإِفَاضَةَ حَتَّى خَرَجَ مِنْ مَكَّةَ، وَرَجَعَ إِلَى بِلَادِهِ، فَقَالَ : أَرَى إِنْ لَمْ يَكُنْ أَصَابَ النِّسَاءَ، فَلْيَرْجِعْ، فَلْيُفِضْ، وَإِنْ كَانَ أَصَابَ النِّسَاءَ فَلْيَرْجِعْ، فَلْيُفِضْ، ثُمَّ لِيَعْتَمِرْ، وَلْيُهْدِ، وَلَا يَنْبَغِي لَهُ أَنْ يَشْتَرِيَ هَدْيَهُ مِنْ مَكَّةَ، وَيَنْحَرَهُ بِهَا وَلَكِنْ إِنْ لَمْ يَكُنْ سَاقَهُ مَعَهُ مِنْ حَيْثُ اعْتَمَرَ، فَلْيَشْتَرِهِ بِمَكَّةَ، ثُمَّ لِيُخْرِجْهُ إِلَى الْحِلِّ، فَلْيَسُقْهُ مِنْهُ إِلَى مَكَّةَ، ثُمَّ يَنْحَرُهُ بِهَا
Yahya said: It was asked to Imam Malik, may Allah have mercy on him, about a person who forgot to perform the Tawaf al-Ziyarah and returned to his city from Makkah? He replied: If he has not had intercourse with his wife, he should return and perform the Tawaf al-Ziyarah. But if he has had intercourse, then he should return and perform the Tawaf, then perform ‘Umrah and offer a sacrifice (hady). And he should not buy the hady from Makkah and slaughter it there; rather, if he did not bring the hady with him, he should buy the hady from Makkah, take it outside the Haram, then drive it back with him to Makkah, and then slaughter it there.
