Hadith Q797
عَنْ مَالِكٍ قَالَ : مَنْ حُبِسَ بِعَدُوٍّ ، فَحَالَ بَيْنَهُ وَبَيْنَ الْبَيْتِ ، فَإِنَّهُ يَحِلُّ مِنْ كُلِّ شَيْءٍ ، وَيَنْحَرُ هَدْيَهُ ، وَيَحْلِقُ رَأْسَهُ حَيْثُ حُبِسَ وَلَيْسَ عَلَيْهِ قَضَاءٌ.
Imam Malik, may Allah have mercy on him, said: Whoever is prevented (from completing Hajj or Umrah) due to an enemy, and because of this is unable to reach the House of Allah, then he should exit the state of ihram, slaughter his sacrificial animal, and shave his head at the place where he was prevented, and there is no (obligatory) make-up (qada) upon him.
Hadith 797
عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ أَنَّ رَسُولَ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حَلَّ هُوَ وَأَصْحَابُهُ بِالْحُدَيْبِيَةِ. فَنَحَرُوا الْهَدْيَ ، وَحَلَقُوا رُءُوسَهُمْ ، وَحَلُّوا مِنْ كُلِّ شَيْءٍ قَبْلَ أَنْ يَطُوفُوا بِالْبَيْتِ. وَقَبْلَ أَنْ يَصِلَ إِلَيْهِ الْهَدْيُ ، ثُمَّ لَمْ يُعْلَمْ أَنَّ رَسُولَ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَمَرَ أَحَدًا مِنْ أَصْحَابِهِ ، وَلَا مِمَّنْ كَانَ مَعَهُ ، أَنْ يَقْضُوا شَيْئًا ، وَلَا يَعُودُوا لِشَيْءٍ.
It reached Imam Malik (may Allah have mercy on him) that the Messenger of Allah (peace and blessings be upon him) and his companions (may Allah be pleased with them), when the disbelievers prevented them, opened their ihram at Hudaybiyyah, sacrificed their sacrificial animals, shaved their heads, and became lawful for everything before performing the circumambulation of the Ka'bah and before their sacrificial animals reached the House of Allah. Then we do not know that the Messenger of Allah (peace and blessings be upon him) ordered any of his companions or associates to repeat or make up for it.
Hadith 798
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ قَالَ حِينَ خَرَجَ إِلَى مَكَّةَ مُعْتَمِرًا فِي الْفِتْنَةِ: إِنْ صُدِدْتُ عَنْ الْبَيْتِ صَنَعْنَا كَمَا صَنَعْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ،
" فَأَهَلَّ بِعُمْرَةٍ مِنْ أَجْلِ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَهَلَّ بِعُمْرَةٍ عَامَ الْحُدَيْبِيَةِ " ، ثُمَّ إِنَّ عَبْدَ اللَّهِ نَظَرَ فِي أَمْرِهِ ، فَقَالَ: مَا أَمْرُهُمَا إِلَّا وَاحِدٌ ، ثُمَّ الْتَفَتَ إِلَى أَصْحَابِهِ ، فَقَالَ: مَا أَمْرُهُمَا إِلَّا وَاحِدٌ ، أُشْهِدُكُمْ أَنِّي قَدْ أَوْجَبْتُ الْحَجَّ مَعَ الْعُمْرَةِ ، ثُمَّ نَفَذَ حَتَّى جَاءَ الْبَيْتَ فَطَافَ طَوَافًا وَاحِدًا ، وَرَأَى ذَلِكَ مُجْزِيًا عَنْهُ وَأَهْدَى
When Abdullah bin Umar (may Allah be pleased with them both) set out towards Makkah with the intention of Umrah in the year when there was turmoil (that is, when Hajjaj bin Yusuf came to fight Abdullah bin Zubair, may Allah be pleased with him, who was the ruler of Makkah), he said: If I am prevented from reaching the House of Allah, I will do as I did with the Messenger of Allah (peace and blessings be upon him) (when the disbelievers prevented him). So Abdullah bin Umar (may Allah be pleased with them both) entered into the state of Ihram for Umrah, thinking that the Messenger of Allah (peace and blessings be upon him) had also entered into Ihram for Umrah in the year of Hudaybiyyah. Then Abdullah bin Umar (may Allah be pleased with them both) reflected and said that the ruling of Umrah and Hajj is the same in the state of being prevented (ihsar). Then he turned to his companions and said that the case of Hajj and Umrah is the same. I make you witnesses that I have made Hajj obligatory upon myself along with Umrah. Then Abdullah (may Allah be pleased with him) went on until he reached the House of Allah, performed one Tawaf, considered it sufficient, and sacrificed the Hady.
Hadith 798B1
قَالَ مَالِك: فَهَذَا الْأَمْرُ عِنْدَنَا فِيمَنْ أُحْصِرَ بِعَدُوٍّ ، كَمَا أُحْصِرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَصْحَابُهُ ۱؎ ¤ فَأَمَّا مَنْ أُحْصِرَ بِغَيْرِ عَدُوٍّ ، فَإِنَّهُ لَا يَحِلُّ دُونَ الْبَيْتِ ۲؎
Imam Malik, may Allah have mercy on him, said: In our view, the ruling for one who is prevented (from Hajj or Umrah) due to an enemy is the same as what the Prophet, peace be upon him, and his companions did.
Imam Malik, may Allah have mercy on him, said: Whoever is prevented for any reason other than an enemy will not become halal (released from ihram) except after reaching the House of Allah.
