Hadith 784
It is narrated from Sayyiduna Sa'b bin Jaththamah Al-Laithi (may Allah be pleased with him) that he sent a wild donkey as a gift to the Messenger of Allah (peace and blessings be upon him) while he (peace and blessings be upon him) was at Abwa or Waddan (these are the names of two places). The Messenger of Allah (peace and blessings be upon him) returned it. Sayyiduna Sa'b (may Allah be pleased with him) says: When the Messenger of Allah (peace and blessings be upon him) saw the expression on my face (i.e., I was saddened because he returned it, and he realized this by looking at my face), he (peace and blessings be upon him) said: "We have returned it because we are in the state of Ihram."
Hadith 785
It is narrated from Abdullah bin Amir bin Rabi'ah that I saw Sayyiduna Uthman bin Affan, may Allah be pleased with him, at 'Arj on a hot day; he had covered his face with a red blanket. Meanwhile, some game meat was brought, so he said to his companions: Eat. They said: Will you not eat? He, may Allah be pleased with him, replied: I am not like you; it has been hunted for my sake.
Hadith 786
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، عَنْ
أَبِيهِ ، عَنْ
عَائِشَةَ أُمِّ الْمُؤْمِنِينَ ، أَنَّهَا قَالَتْ لَهُ : " يَا ابْنَ أُخْتِي إِنَّمَا
هِيَ عَشْرُ لَيَالٍ فَإِنْ تَخَلَّجَ فِي نَفْسِكَ شَيْءٌ فَدَعْهُ " تَعْنِي أَكْلَ لَحْمِ الصَّيْدِ
Umm al-Mu'mineen Sayyidah Aisha (may Allah be pleased with her) said to Urwah bin Zubair: O son of my brother! These are the ten nights of Ihram. If you have any doubt in your heart, then completely abstain from the meat of game.
Hadith 786B1
قَالَ مَالِك فِي الرَّجُلِ الْمُحْرِمِ يُصَادُ مِنْ أَجْلِهِ صَيْدٌ ، فَيُصْنَعُ لَهُ ذَلِكَ الصَّيْدُ فَيَأْكُلُ مِنْهُ وَهُوَ يَعْلَمُ أَنَّهُ مِنْ أَجْلِهِ صِيدَ : فَإِنَّ عَلَيْهِ جَزَاءَ ذَلِكَ الصَّيْدِ كُلِّهِ
Imam Malik, may Allah have mercy on him, said that if game is hunted for the sake of a muhrim, and he eats it knowing that it was hunted for him, then its penalty is obligatory upon him.
Hadith 786B2
وَسُئِلَ مَالِك ، عَنِ الرَّجُلِ يُضْطَرُّ إِلَى أَكْلِ الْمَيْتَةِ وَهُوَ مُحْرِمٌ ، أَيَصِيدُ الصَّيْدَ فَيَأْكُلُهُ أَمْ يَأْكُلُ الْمَيْتَةَ ؟ فَقَالَ : بَلْ يَأْكُلُ الْمَيْتَةَ ، وَذَلِكَ أَنَّ اللَّهَ تَبَارَكَ وَتَعَالَى لَمْ يُرَخِّصْ لِلْمُحْرِمِ فِي أَكْلِ الصَّيْدِ ، وَلَا فِي أَخْذِهِ فِي حَالٍ مِنَ الْأَحْوَالِ ، وَقَدْ أَرْخَصَ فِي الْمَيْتَةِ عَلَى حَالِ الضَّرُورَةِ
Imam Malik, may Allah have mercy on him, was asked: If a person is in such a state of necessity that carrion becomes lawful for him, and he is in the state of ihram, should he hunt and eat or eat carrion? Imam Malik, may Allah have mercy on him, replied: He should eat carrion, because Allah, Glorious and Exalted is He, has not given permission to the muhrim (one in ihram) to hunt in any situation, but has given permission to eat carrion at the time of necessity.
Hadith 786B3
قَالَ مَالِك : وَأَمَّا مَا قَتَلَ الْمُحْرِمُ أَوْ ذَبَحَ مِنَ الصَّيْدِ ، فَلَا يَحِلُّ أَكْلُهُ لِحَلَالٍ وَلَا لِمُحْرِمٍ ، لِأَنَّهُ لَيْسَ بِذَكِيٍّ كَانَ خَطَأً أَوْ عَمْدًا فَأَكْلُهُ لَا يَحِلُّ ، وَقَدْ سَمِعْتُ ذَلِكَ مِنْ غَيْرِ وَاحِدٍ
Imam Malik, may Allah have mercy on him, said: The game that is killed or slaughtered, its eating is not permissible for anyone, neither for the Muhrim nor for the Halal, because it has not been properly slaughtered. It makes no difference whether it was killed by mistake or intentionally, in no case is it permissible. Imam Malik, may Allah have mercy on him, said: I have heard this issue from many people.
Hadith 786B4
وَالَّذِي يَقْتُلُ الصَّيْدَ ثُمَّ يَأْكُلُهُ إِنَّمَا عَلَيْهِ كَفَّارَةٌ وَاحِدَةٌ ، مِثْلُ مَنْ قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُ
Imam Malik, may Allah have mercy on him, said: Whoever hunts and eats the game, then only one expiation is required of him, just like the person who hunts but does not eat.
