بَابُ مَا يَجُوزُ لِلْمُحْرِمِ أَكْلُهُ مِنَ الصَّيْدِ
Chapter on What is Permissible for a Person in Ihram to Eat from Game
Hadith 777
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ أَبِي النَّضْرِ مَوْلَى عُمَرَ بْنِ عُبَيْدِ اللَّهِ التَّيْمِيِّ ، عَنْ نَافِعٍ مَوْلَى أَبِي قَتَادَةَ الْأَنْصَارِيِّ ، عَنْ أَبِي قَتَادَةَ أَنَّهُ كَانَ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، حَتَّى إِذَا كَانُوا بِبَعْضِ طَرِيقِ مَكَّةَ تَخَلَّفَ مَعَ أَصْحَابٍ لَهُ مُحْرِمِينَ ، وَهُوَ غَيْرُ مُحْرِمٍ فَرَأَى حِمَارًا وَحْشِيًّا ، فَاسْتَوَى عَلَى فَرَسِهِ فَسَأَلَ أَصْحَابَهُ أَنْ يُنَاوِلُوهُ سَوْطَهُ ، فَأَبَوْا عَلَيْهِ فَسَأَلَهُمْ رُمْحَهُ فَأَبَوْا فَأَخَذَهُ ، ثُمَّ شَدَّ عَلَى الْحِمَارِ فَقَتَلَهُ ، فَأَكَلَ مِنْهُ بَعْضُ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَبَى بَعْضُهُمْ ، فَلَمَّا أَدْرَكُوا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَأَلُوهُ عَنْ ذَلِكَ ، فَقَالَ : " إِنَّمَا هِيَ طُعْمَةٌ أَطْعَمَكُمُوهَا اللَّهُ "
It is narrated from Sayyiduna Abu Qatadah Ansari (may Allah be pleased with him) that he was with the Messenger of Allah (peace and blessings be upon him), and so on a journey behind Makkah he lagged behind with some of his companions who had entered into the state of ihram. But Sayyiduna Abu Qatadah (may Allah be pleased with him) had not entered into ihram. He saw a wild donkey, so he mounted his horse and asked his companions for a whip, but they refused. Then he asked for a spear, but they refused. Finally, he himself took a spear and attacked the wild donkey and killed it. Some of the companions ate its meat and some refused. When they met the Messenger of Allah (peace and blessings be upon him), they informed him about it. He (peace and blessings be upon him) said: "It was a meal which Allah, the Glorious and Exalted, fed you."
Hadith 778
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، أَنَّ الزُّبَيْرَ بْنَ الْعَوَّامِ ، " كَانَ يَتَزَوَّدُ صَفِيفَ الظِّبَاءِ وَهُوَ مُحْرِمٌ " . ¤ قَالَ مَالِك : وَالصَّفِيفُ : الْقَدِيدُ
It is narrated from Hazrat Urwah bin Zubair that Sayyiduna Zubair bin Al-Awwam (may Allah be pleased with him) used to have roasted venison for breakfast while he was in the state of ihram.
Imam Malik (may Allah have mercy on him) said: This is what is called qadeed.

Hadith 779
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، أَنَّ عَطَاءَ بْنَ يَسَارٍ أَخْبَرَهُ ، عَنْ أَبِي قَتَادَةَ فِي الْحِمَارِ الْوَحْشِيِّ مِثْلَ حَدِيثِ أَبِي النَّضْرِ إِلَّا أَنَّ فِي حَدِيثِ زَيْدِ بْنِ أَسْلَمَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " هَلْ مَعَكُمْ مِنْ لَحْمِهِ شَيْءٌ ؟ "
Ata bin Yasar narrated the hadith of Sayyiduna Abu Qatadah (may Allah be pleased with him) about hunting a wild donkey, just as mentioned above, but in this hadith there is an addition that the Messenger of Allah (peace and blessings be upon him) asked: "Do you have any of that meat left with you?"
Hadith 780
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ يَحْيَى بْنِ سَعِيدٍ الْأَنْصَارِيِّ ، أَنَّهُ قَالَ : أَخْبَرَنِي مُحَمَّدُ بْنُ إِبْرَاهِيمَ بْنِ الْحَارِثِ التَّيْمِيُّ ، عَنْ عِيسَى بْنِ طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ ، عَنْ عُمَيْرِ بْنِ سَلَمَةَ الضَّمْرِيِّ ، عَنْ الْبَهْزِيِّ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ يُرِيدُ مَكَّةَ وَهُوَ مُحْرِمٌ حَتَّى إِذَا كَانَ بِالرَّوْحَاءِ إِذَا حِمَارٌ وَحْشِيٌّ عَقِيرٌ فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " دَعُوهُ فَإِنَّهُ يُوشِكُ أَنْ يَأْتِيَ صَاحِبُهُ " ، فَجَاءَ الْبَهْزِيُّ وَهُوَ صَاحِبُهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ ، فَأَمَرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَبَا بَكْرٍ فَقَسَمَهُ بَيْنَ الرِّفَاقِ ، ثُمَّ مَضَى حَتَّى إِذَا كَانَ بِالْأُثَابَةِ بَيْنَ الرُّوَيْثَةِ ، وَالْعَرْجِ إِذَا ظَبْيٌ حَاقِفٌ فِي ظِلٍّ فِيهِ سَهْمٌ فَزَعَمَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ رَجُلًا أَنْ يَقِفَ عِنْدَهُ لَا يَرِيبُهُ أَحَدٌ مِنَ النَّاسِ حَتَّى يُجَاوِزَهُ
It is narrated from Sayyiduna Zayd bin Ka’b Bahzi (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) set out wearing the Ihram with the intention of Makkah. When he reached Rauha (Rauha is a place between Makkah and Madinah), he saw a wounded wild donkey. This was mentioned to the Messenger of Allah (peace and blessings of Allah be upon him), and he said: “Leave it as it is, its owner will come.” Meanwhile, Sayyiduna Bahzi (may Allah be pleased with him) arrived, and he was its owner. He said: “O Messenger of Allah! You have authority over this wild donkey.” The Messenger of Allah (peace and blessings of Allah be upon him) instructed Sayyiduna Abu Bakr (may Allah be pleased with him), and he distributed its meat among all the companions. Then the Messenger of Allah (peace and blessings of Allah be upon him) moved on, and when he reached Athabah, which is between Ruwaitha and ‘Arj (Athabah, Ruwaitha, and ‘Arj are all names of places), he saw a deer standing in the shade with its head lowered and an arrow stuck in it. Sayyiduna Bahzi (may Allah be pleased with him) said that the Messenger of Allah (peace and blessings of Allah be upon him) instructed a person to stand by it so that no one would disturb it until the people had moved on.
Hadith 781
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيَّبِ يُحَدِّثُ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّهُ أَقْبَلَ مِنْ الْبَحْرَيْنِ حَتَّى إِذَا كَانَ بِالرَّبَذَةِ وَجَدَ رَكْبًا مِنْ أَهْلِ الْعِرَاقِ مُحْرِمِينَ ، فَسَأَلُوهُ عَنْ لَحْمِ صَيْدٍ وَجَدُوهُ عِنْدَ أَهْلِ الرَّبَذَةِ فَأَمَرَهُمْ بِأَكْلِهِ ، قَالَ أَبُو هُرَيْرَةَ : " ثُمَّ إِنِّي شَكَكْتُ فِيمَا أَمَرْتُهُمْ بِهِ فَلَمَّا قَدِمْتُ الْمَدِينَةَ ذَكَرْتُ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ " ، فَقَالَ عُمَرُ : " مَاذَا أَمَرْتَهُمْ بِهِ ؟ " فَقَالَ : أَمَرْتُهُمْ بِأَكْلِهِ ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ : " لَوْ أَمَرْتَهُمْ بِغَيْرِ ذَلِكَ لَفَعَلْتُ بِكَ " يَتَوَاعَدُهُ
When Abu Huraira (may Allah be pleased with him) returned from Bahrain and reached Rabdha, he met some riders from Iraq who were in the state of Ihram. They asked Abu Huraira (may Allah be pleased with him) about the ruling on the meat of game that was with the people of Rabdha. Abu Huraira (may Allah be pleased with him) permitted them to eat it. Then he said that he became doubtful about this ruling, so when he came to Madinah, he mentioned it to Umar ibn al-Khattab (may Allah be pleased with him). Umar (may Allah be pleased with him) asked: What ruling did you give them? I said: I permitted them to eat it. Umar (may Allah be pleased with him) said: If you had given them any other ruling, I would have done such and such to you, meaning he began to warn him.
Hadith 782
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ ابْنِ شِهَابٍ ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يُحَدِّثُ عَبْدَ اللَّهِ بْنَ عُمَرَ ، أَنَّهُ مَرَّ بِهِ قَوْمٌ مُحْرِمُونَ بِالرَّبَذَةِ فَاسْتَفْتَوْهُ فِي لَحْمِ صَيْدٍ ، وَجَدُوا نَاسًا أَحِلَّةً يَأْكُلُونَهُ فَأَفْتَاهُمْ بِأَكْلِهِ ، قَالَ : ثُمَّ قَدِمْتُ الْمَدِينَةَ عَلَى عُمَرَ بْنِ الْخَطَّابِ فَسَأَلْتُهُ عَنْ ذَلِكَ ، فَقَالَ : " بِمَ أَفْتَيْتَهُمْ ؟ " ، قَالَ : فَقُلْتُ : " أَفْتَيْتُهُمْ بِأَكْلِهِ " ، قَالَ : فَقَالَ عُمَرُ : " لَوْ أَفْتَيْتَهُمْ بِغَيْرِ ذَلِكَ لَأَوْجَعْتُكَ "
Hazrat Salim bin Abdullah heard from Sayyiduna Abu Huraira (may Allah be pleased with him), who said to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that some people in Ihram met me at Rabdha, so they asked about the meat of game that was with people who were not in Ihram, whether they could eat it. Sayyiduna Abu Huraira (may Allah be pleased with him) permitted them to eat it. Sayyiduna Abu Huraira (may Allah be pleased with him) said: When I came to Madinah to Sayyiduna Umar (may Allah be pleased with him), I informed him, and he asked: What verdict did you give? I said: I gave the verdict to eat it. Sayyiduna Umar (may Allah be pleased with him) said: If you had given a verdict other than this, I would have punished you.
Hadith 783
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ عَطَاءِ بْنِ يَسَارٍ ، أَنَّ كَعْبَ الْأَحْبَارِ أَقْبَلَ مِنْ الشَّامِ فِي رَكْبٍ حَتَّى إِذَا كَانُوا بِبَعْضِ الطَّرِيقِ وَجَدُوا لَحْمَ صَيْدٍ ، فَأَفْتَاهُمْ كَعْبٌ بِأَكْلِهِ ، قَالَ : فَلَمَّا قَدِمُوا عَلَى عُمَرَ بْنِ الْخَطَّابِ بِالْمَدِينَةِ ذَكَرُوا ذَلِكَ لَهُ ، فَقَالَ : " مَنْ أَفْتَاكُمْ بِهَذَا ؟ " قَالُوا : كَعْبٌ ، قَالَ : " فَإِنِّي قَدْ أَمَّرْتُهُ عَلَيْكُمْ حَتَّى تَرْجِعُوا " ، ثُمَّ لَمَّا كَانُوا بِبَعْضِ طَرِيقِ مَكَّةَ مَرَّتْ بِهِمْ رِجْلٌ مِنْ جَرَادٍ ، فَأَفْتَاهُمْ كَعْبٌ أَنْ يَأْخُذُوهُ فَيَأْكُلُوهُ ، فَلَمَّا قَدِمُوا عَلَى عُمَرَ بْنِ الْخَطَّابِ ذَكَرُوا لَهُ ذَلِكَ ، فَقَالَ : " مَا حَمَلَكَ عَلَى أَنْ تُفْتِيَهُمْ بِهَذَا ؟ " قَالَ : هُوَ مِنْ صَيْدِ الْبَحْرِ ، قَالَ : " وَمَا يُدْرِيكَ ؟ " ، قَالَ : يَا أَمِيرَ الْمُؤْمِنِينَ وَالَّذِي نَفْسِي بِيَدِهِ ، إِنْ هِيَ إِلَّا نَثْرَةُ حُوتٍ يَنْثُرُهُ فِي كُلِّ عَامٍ مَرَّتَيْنِ "
When Sayyiduna Ka'b al-Ahbar (may Allah be pleased with him) came from Syria, there were some riders with him who had put on ihram on the way. They saw the meat of game, so Sayyiduna Ka'b al-Ahbar (may Allah be pleased with him) permitted them to eat it. When they came to Madinah, they related this to Sayyiduna Umar (may Allah be pleased with him). He said: Who gave you this fatwa? They replied: Sayyiduna Ka'b (may Allah be pleased with him) did. Sayyiduna Umar (may Allah be pleased with him) said: I have made Ka'b your ruler until you return. Then one day, on the way to Makkah, they came across a swarm of locusts. Sayyiduna Ka'b (may Allah be pleased with him) gave the fatwa that they could catch and eat them. When those people came to Sayyiduna Umar (may Allah be pleased with him), they related this to him. He (may Allah be pleased with him) asked Sayyiduna Ka'b (may Allah be pleased with him): How did you give this fatwa? Sayyiduna Ka'b (may Allah be pleased with him) said that the locust is the game of the sea. Sayyiduna Umar (may Allah be pleased with him) said: How so? Sayyiduna Ka'b (may Allah be pleased with him) said: O Commander of the Faithful! By the One in Whose hand is my soul! The locust comes out from the sneeze of a fish, which sneezes twice every year.
Hadith 783B1
وَسُئِلَ مَالِك ، عَمَّا يُوجَدُ مِنْ لُحُومِ الصَّيْدِ عَلَى الطَّرِيقِ هَلْ يَبْتَاعُهُ الْمُحْرِمُ ؟ فَقَالَ : أَمَّا مَا كَانَ مِنْ ذَلِكَ يُعْتَرَضُ بِهِ الْحَاجُّ ، وَمِنْ أَجْلِهِمْ صِيدَ فَإِنِّي أَكْرَهُهُ وَأَنْهَى عَنْهُ ، فَأَمَّا أَنْ يَكُونَ عِنْدَ رَجُلٍ لَمْ يُرِدْ بِهِ الْمُحْرِمِينَ فَوَجَدَهُ مُحْرِمٌ فَابْتَاعَهُ فَلَا بَأْسَ بِهِ
Imam Malik, may Allah have mercy on him, was asked whether a muhrim (person in the state of ihram) should buy game meat found on the way or not. He replied that if the game is hunted for the sake of the pilgrims, then I consider it disliked. However, if it was not hunted for the muhrim but he happens to find it, then there is no harm in buying it.
Hadith 783B2
قَالَ مَالِك فِيمَنْ أَحْرَمَ وَعِنْدَهُ صَيْدٌ قَدْ صَادَهُ أَوِ ابْتَاعَهُ : فَلَيْسَ عَلَيْهِ أَنْ يُرْسِلَهُ ، وَلَا بَأْسَ أَنْ يَجْعَلَهُ عِنْدَ أَهْلِهِ
Imam Malik, may Allah have mercy on him, said: If a person enters into the state of ihram and he has a game animal which he has caught or purchased, then it is not necessary for him to release it; rather, he may keep it in his house.
Hadith 783B3
قَالَ مَالِك فِي صَيْدِ الْحِيتَانِ فِي الْبَحْرِ وَالْأَنْهَارِ وَالْبِرَكِ وَمَا أَشْبَهَ ذَلِكَ : إِنَّهُ حَلَالٌ لِلْمُحْرِمِ أَنْ يَصْطَادَهُ
Imam Malik, may Allah have mercy on him, said: Hunting fish in rivers, streams, and ponds is lawful for a person in the state of ihram.
