Hadith 753
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ
عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدٍ ، عَنْ
عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ أَنَّهَا أَخْبَرَتْهُ ، أَنَّ
زِيَادَ بْنَ أَبِي سُفْيَانَ كَتَبَ إِلَى عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ ، قَالَ : مَنْ أَهْدَى هَدْيًا حَرُمَ عَلَيْهِ مَا يَحْرُمُ عَلَى الْحَاجِّ ، حَتَّى يُنْحَرَ الْهَدْيُ ، وَقَدْ بَعَثْتُ بِهَدْيٍ فَاكْتُبِي إِلَيَّ بِأَمْرِكِ أَوْ مُرِي صَاحِبَ الْهَدْيِ ، قَالَتْ عَمْرَةُ : قَالَتْ
عَائِشَةُ لَيْسَ كَمَا قَالَ ابْنُ عَبَّاسٍ : " أَنَا
فَتَلْتُ قَلَائِدَ هَدْيِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِيَدَيَّ ، ثُمَّ قَلَّدَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِيَدِهِ ، ثُمَّ بَعَثَ بِهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَعَ أَبِي ، فَلَمْ يَحْرُمْ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ شَيْءٌ أَحَلَّهُ اللَّهُ لَهُ ، حَتَّى نُحِرَ الْهَدْيُ "
It is narrated from Hazrat Amrah bint Abdur Rahman that Ziyad bin Abi Sufyan wrote to Ummul Momineen Sayyidah Aisha (may Allah be pleased with her): Sayyiduna Abdullah bin Abbas (may Allah be pleased with both of them) says: Whoever sends a sacrificial animal (hadi), those things become forbidden for him which are forbidden for a person in the state of ihram, until the sacrificial animal is slaughtered. So I have sent a sacrificial animal to you, write to me your verdict or send it through the person who brings the sacrificial animal. Amrah said: Sayyidah Aisha (may Allah be pleased with her) said: What Ibn Abbas (may Allah be pleased with both of them) says is not so. I myself tied the necklaces of the sacrificial animals of the Messenger of Allah (peace and blessings be upon him) with my own hands, and the Messenger of Allah (peace and blessings be upon him) hung them with his own hands and sent them with my father, so nothing became forbidden for him from those things which Allah had made lawful for him, until the sacrificial animal was slaughtered.
Hadith 754
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، أَنَّهُ قَالَ : سَأَلْتُ
عَمْرَةَ بِنْتَ عَبْدِ الرَّحْمَنِ عَنِ الَّذِي يَبْعَثُ بِهَدْيِهِ وَيُقِيمُ ، هَلْ يَحْرُمُ عَلَيْهِ شَيْءٌ ؟ فَأَخْبَرَتْنِي ، أَنَّهَا سَمِعَتْ
عَائِشَةَ ، تَقُولُ :
" لَا يَحْرُمُ إِلَّا مَنْ أَهَلَّ وَلَبَّى "
It is narrated from Yahya bin Saeed, he asked Umrah bint Abdur Rahman that if a person sends a sacrificial animal (hadi) but does not go himself, is anything obligatory upon him? She replied: I heard from Sayyidah Aisha (may Allah be pleased with her), she used to say: No one becomes a pilgrim (muhrim) except the one who puts on the ihram and recites the talbiyah.
Hadith 755
Rabee’ah bin Abdullah saw a man in Iraq who had removed his clothes (and that man was Sayyiduna Ibn Abbas, may Allah be pleased with them both), so he asked the people about the reason. The people said: He has ordered the marking of his sacrificial animal, so for that reason he has removed his stitched clothes. Rabee’ah said: I met Sayyiduna Abdullah bin Zubair, may Allah be pleased with him, and narrated this incident to him. He said: By the Lord of the Ka’bah! This act is an innovation.
Hadith 755B1
وَسُئِلَ مَالِك ، عَمَّنْ خَرَجَ بِهَدْيٍ لِنَفْسِهِ فَأَشْعَرَهُ وَقَلَّدَهُ بِذِي الْحُلَيْفَةِ وَلَمْ يُحْرِمْ هُوَ حَتَّى جَاءَ الْجُحْفَةَ ؟ قَالَ : لَا أُحِبُّ ذَلِكَ وَلَمْ يُصِبْ مَنْ فَعَلَهُ ، وَلَا يَنْبَغِي لَهُ أَنْ يُقَلِّدَ الْهَدْيَ وَلَا يُشْعِرَهُ إِلَّا عِنْدَ الْإِهْلَالِ إِلَّا رَجُلٌ لَا يُرِيدُ الْحَجَّ ، فَيَبْعَثُ بِهِ وَيُقِيمُ فِي أَهْلِهِ
Imam Malik, may Allah have mercy on him, was asked about a person who set out with a sacrificial animal, performed the marking and garlanding at Dhu’l-Hulayfah, but did not enter into ihram until he reached Juhfah. Imam Malik, may Allah have mercy on him, replied: In my view, this is not good, and whoever does so has made a mistake. Rather, he should perform the marking and garlanding together with ihram. However, a person who does not intend to go with the sacrificial animal may send it without ihram and remain seated at his home.
Hadith 755B2
وَسُئِلَ مَالِك هَلْ يَخْرُجُ بِالْهَدْيِ غَيْرُ مُحْرِمٍ ؟ فَقَالَ : نَعَمْ لَا بَأْسَ بِذَلِكَ
Imam Malik, may Allah have mercy on him, was asked whether one can set out with the sacrificial animal (hady) without entering into ihram. He replied: Yes, there is no objection (but when he reaches the miqat, he should enter into ihram from there; he should not proceed further without ihram).
Hadith 755B3
وَسُئِلَ أَيْضًا عَمَّا اخْتَلَفَ فِيهِ النَّاسُ مِنَ الْإِحْرَامِ لِتَقْلِيدِ الْهَدْيِ ، مِمَّنْ لَا يُرِيدُ الْحَجَّ وَلَا الْعُمْرَةَ ، فَقَالَ : الْأَمْرُ عِنْدَنَا الَّذِي نَأْخُذُ بِهِ فِي ذَلِكَ قَوْلُ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ ، إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " بَعَثَ بِهَدْيِهِ ، ثُمَّ أَقَامَ فَلَمْ يَحْرُمْ عَلَيْهِ شَيْءٌ مِمَّا أَحَلَّهُ اللَّهُ لَهُ حَتَّى نُحِرَ هَدْيُهُ "
Imam Malik, may Allah have mercy on him, was asked that people have differed in this matter: if a person imitates (performs) the sacrifice of his Hadi (sacrificial animal) but does not intend Hajj or Umrah, will he become a Muhrim (enter the state of Ihram) or not? Imam Malik, may Allah have mercy on him, replied that in this issue we take the statement of Umm al-Mu'mineen Sayyida Aisha, may Allah be pleased with her, that the Messenger of Allah, peace and blessings be upon him, sent his Hadi (sacrificial animal) and he stayed (did not go for Hajj or Umrah), so nothing from the lawful things became unlawful for him, until the Hadi was slaughtered.
