Hadith 742
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ
جَعْفَرِ بْنِ مُحَمَّدٍ ، عَنْ
أَبِيهِ ، أَنَّ الْمِقْدَادَ بْنَ الْأَسْوَدِ دَخَلَ عَلَى عَلِيِّ بْنِ أَبِي طَالِبٍ بِالسُّقْيَا ، وَهُوَ يَنْجَعُ بَكَرَاتٍ لَهُ دَقِيقًا وَخَبَطًا ، فَقَالَ : هَذَا
عُثْمَانُ بْنُ عَفَّانَ يَنْهَى عَنْ أَنْ يُقْرَنَ بَيْنَ الْحَجِّ وَالْعُمْرَةِ ، فَخَرَجَ عَلِيُّ بْنُ أَبِي طَالِبٍ وَعَلَى يَدَيْهِ أَثَرُ الدَّقِيقِ وَالْخَبَطِ ، فَمَا أَنْسَى أَثَرَ الدَّقِيقِ وَالْخَبَطِ عَلَى ذِرَاعَيْهِ ، حَتَّى دَخَلَ عَلَى عُثْمَانَ بْنِ عَفَّانَ ، فَقَالَ : " أَنْتَ تَنْهَى عَنْ أَنْ يُقْرَنَ بَيْنَ الْحَجِّ وَالْعُمْرَةِ " ، فَقَالَ عُثْمَانُ : ذَلِكَ رَأْيِي فَخَرَجَ
عَلِيٌّ مُغْضَبًا ، وَهُوَ يَقُولُ :
" لَبَّيْكَ اللَّهُمَّ لَبَّيْكَ بِحَجَّةٍ وَعُمْرَةٍ مَعًا "
It is narrated from Muhammad Baqir that Sayyiduna Miqdad bin Aswad (may Allah be pleased with him) came to Sayyiduna Ali (may Allah be pleased with him) and he was feeding his young camels a mixture of flour and fodder in water. So Sayyiduna Miqdad (may Allah be pleased with him) said: Sayyiduna Uthman bin Affan (may Allah be pleased with him) forbids Qiran between Hajj and Umrah. Then Sayyiduna Ali (may Allah be pleased with him) went out, and there were marks of flour on his hands—I have not forgotten those marks of flour on his hands until now—and he went to Sayyiduna Uthman bin Affan (may Allah be pleased with him) and said: Do you forbid Qiran between Hajj and Umrah? He said: Yes, this is my opinion. So Sayyiduna Ali (may Allah be pleased with him) went out angrily, saying: «لَبَّيْكَ اَللّٰهُمَّ لَبَّيْكَ بِحَجَّةٍ وَعُمْرَةٍ مَعًا».
Imam Malik (may Allah have mercy on him) said: According to us, the ruling is that whoever performs Qiran should not cut his hair, nor use the things prohibited in Ihram, until he sacrifices the Hady, if he has a Hady with him, and opens his Ihram in Mina on the Day of Nahr.
Hadith 743
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حَجَّةِ الْوَدَاعِ
" خَرَجَ إِلَى الْحَجِّ ، فَمِنْ أَصْحَابِهِ مَنْ أَهَلَّ بِحَجٍّ ، وَمِنْهُمْ مَنْ جَمَعَ الْحَجَّ وَالْعُمْرَةَ ، وَمِنْهُمْ مَنْ أَهَلَّ بِعُمْرَةٍ فَقَطْ ، فَأَمَّا مَنْ أَهَلَّ بِحَجٍّ أَوْ جَمَعَ الْحَجَّ وَالْعُمْرَةَ فَلَمْ يَحْلِلْ ، وَأَمَّا مَنْ كَانَ أَهَلَّ بِعُمْرَةٍ فَحَلُّوا "
It is narrated from Sulayman bin Yasar that the Messenger of Allah, may Allah bless him and grant him peace, set out in the year of the Farewell Pilgrimage to perform Hajj. Some of his companions entered into the state of ihram for Hajj, some for both Hajj and Umrah, and some for Umrah only. So whoever had entered into ihram for Hajj or for both Hajj and Umrah did not come out of ihram, and whoever had entered into ihram for Umrah only, after performing Umrah, came out of ihram.
Hadith 743B1
وَحَدَّثَنِي ، عَنْ مَالِك ، أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ يَقُولُونَ : مَنْ أَهَلَّ بِعُمْرَةٍ ، ثُمَّ بَدَا لَهُ أَنْ يُهِلَّ بِحَجٍّ مَعَهَا ، فَذَلِكَ لَهُ مَا لَمْ يَطُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا ، وَالْمَرْوَةِ وَقَدْ صَنَعَ ذَلِكَ ابْنُ عُمَرَ ، حِينَ قَالَ : إِنْ صُدِدْتُ عَنْ الْبَيْتِ صَنَعْنَا كَمَا صَنَعْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، ثُمَّ الْتَفَتَ إِلَى أَصْحَابِهِ ، فَقَالَ : مَا أَمْرُهُمَا إِلَّا وَاحِدٌ أُشْهِدُكُمْ أَنِّي أَوْجَبْتُ الْحَجَّ مَعَ الْعُمْرَةِ
Imam Malik, may Allah have mercy on him, said: I heard from some people of knowledge, they used to say: Whoever put on the ihram for ‘Umrah and then it seemed good to him to also put on the ihram for Hajj along with the ‘Umrah, this is permissible as long as he has not performed the Tawaf of the Ka‘bah and the Sa‘i between Safa and Marwah. And Sayyiduna ‘Abdullah bin ‘Umar, may Allah be pleased with them both, did the same, when he said that I will be prevented from the Ka‘bah, so I will do as the Messenger of Allah, peace and blessings be upon him, did. Then he turned to his companions and said that the state of Hajj and ‘Umrah is the same, so I make you witnesses that I have also made the intention of Hajj along with ‘Umrah.
Hadith 743B2
قَالَ مَالِك : وَقَدْ أَهَلَّ أَصْحَابُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حَجَّةِ الْوَدَاعِ بِالْعُمْرَةِ ، ثُمَّ قَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ كَانَ مَعَهُ هَدْيٌ فَلْيُهْلِلْ بِالْحَجِّ مَعَ الْعُمْرَةِ ، ثُمَّ لَا يَحِلُّ حَتَّى يَحِلَّ مِنْهُمَا جَمِيعًا "
Imam Malik, may Allah have mercy on him, said: The companions of the Messenger of Allah, peace and blessings be upon him, assumed ihram for ‘Umrah in the year of the Farewell Hajj, then the Messenger of Allah, peace and blessings be upon him, said: "Whoever has a sacrificial animal with him should also assume ihram for Hajj, then he should not exit ihram until he has completed both Hajj and ‘Umrah."
