Hadith 620
حَدَّثَنِي حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ
زَيْدِ بْنِ أَسْلَمَ ، عَنْ أَخِيهِ
خَالِدِ بْنِ أَسْلَمَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَفْطَرَ ذَاتَ يَوْمٍ فِي رَمَضَانَ فِي يَوْمٍ ذِي غَيْمٍ ، وَرَأَى أَنَّهُ قَدْ أَمْسَى وَغَابَتِ الشَّمْسُ فَجَاءَهُ رَجُلٌ ، فَقَالَ : يَا أَمِيرَ الْمُؤْمِنِينَ طَلَعَتِ الشَّمْسُ ، فَقَالَ
عُمَرُ :
" الْخَطْبُ يَسِيرٌ وَقَدِ اجْتَهَدْنَا " ¤ قَالَ مَالِك : يُرِيدُ بِقَوْلِهِ الْخَطْبُ يَسِيرٌ ، الْقَضَاءَ فِيمَا نُرَى وَاللَّهُ أَعْلَمُ وَخِفَّةَ مَئُونَتِهِ وَيَسَارَتِهِ يَقُولُ : نَصُومُ يَوْمًا مَكَانَهُ
It is narrated from Hazrat Khalid bin Aslam that Sayyiduna Umar bin Khattab (may Allah be pleased with him) once broke his fast in Ramadan, and that day it was cloudy. He thought that evening had come and the sun had set. Then a person came and said: O Commander of the Faithful! The sun has appeared. Sayyiduna Umar (may Allah be pleased with him) said: Its remedy is easy, we acted according to our assumption.
Imam Malik (may Allah have mercy on him) said: The remedy is easy, meaning that in compensation, we will keep a fast for one day, so the effort is very little and the remedy is easy.
Hadith 621
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
نَافِعٍ ، أَنَّ
عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يَقُولُ :
" يَصُومُ قَضَاءَ رَمَضَانَ مُتَتَابِعًا مَنْ أَفْطَرَهُ مِنْ مَرَضٍ أَوْ فِي سَفَرٍ "
It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: Whoever has to make up missed fasts of Ramadan due to illness or travel, he should make them up consecutively.
Hadith 622
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
ابْنِ شِهَابٍ ، " أَنَّ
عَبْدَ اللَّهِ بْنَ عَبَّاسٍ ،
وَأَبَا هُرَيْرَةَ اخْتَلَفَا فِي قَضَاءِ رَمَضَانَ ، فَقَالَ أَحَدُهُمَا :
" يُفَرِّقُ بَيْنَهُ " ، وَقَالَ الْآخَرُ : " لَا يُفَرِّقُ بَيْنَهُ " ، لَا أَدْرِي أَيَّهُمَا قَالَ : يُفَرِّقُ بَيْنَهُ "
It is narrated from Ibn Shihab that Abdullah bin Abbas (may Allah be pleased with them both) and Abu Huraira (may Allah be pleased with him) differed regarding making up missed fasts of Ramadan. One of them said that it is not necessary to observe the missed fasts consecutively, while the other said that it is necessary to observe them consecutively. But I do not know which of the two said that they must be observed consecutively and which said that it is not necessary.
Hadith 623
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ كَانَ يَقُولُ :
" مَنِ اسْتَقَاءَ وَهُوَ صَائِمٌ فَعَلَيْهِ الْقَضَاءُ ، وَمَنْ ذَرَعَهُ الْقَيْءُ فَلَيْسَ عَلَيْهِ الْقَضَاءُ "
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: Whoever vomits deliberately while fasting, making up the fast becomes obligatory upon him, and whoever vomits unintentionally, then making up the fast is not obligatory upon him.
Hadith 624
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، أَنَّهُ سَمِعَ
سَعِيدَ بْنَ الْمُسَيَّبِ يُسْأَلُ عَنْ قَضَاءِ رَمَضَانَ ، فَقَالَ سَعِيدٌ :
" أَحَبُّ إِلَيَّ أَنْ لَا يُفَرَّقَ قَضَاءُ رَمَضَانَ وَأَنْ يُوَاتَرَ " . ¤ قَالَ يَحْيَى : سَمِعْتُ مَالِكًا ، يَقُولُ فِيمَنْ فَرَّقَ قَضَاءَ رَمَضَانَ : فَلَيْسَ عَلَيْهِ إِعَادَةٌ وَذَلِكَ مُجْزِئٌ عَنْهُ وَأَحَبُّ ذَلِكَ إِلَيَّ أَنْ يُتَابِعَهُ
Yahya ibn Sa'id heard from Sa'id ibn al-Musayyib, he was asked about making up missed fasts of Ramadan, so Sa'id said: In my view, it is good to make up the missed fasts of Ramadan consecutively.
Imam Malik, may Allah have mercy on him, said: Whoever makes up the missed fasts of Ramadan separately, it is not obligatory for him to repeat them, rather the making up will suffice, but in my view, it is better to make them up consecutively.
Hadith 624B
قَالَ مَالِك : مَنْ أَكَلَ أَوْ شَرِبَ فِي رَمَضَانَ سَاهِيًا أَوْ نَاسِيًا أَوْ مَا كَانَ مِنْ صِيَامٍ وَاجِبٍ عَلَيْهِ أَنَّ عَلَيْهِ قَضَاءَ يَوْمٍ مَكَانَهُ
Imam Malik, may Allah have mercy on him, said: Whoever eats or drinks forgetfully in Ramadan, or in any other obligatory fast, then he must make up that fast.
Hadith 625
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
حُمَيْدِ بْنِ قَيْسٍ الْمَكِّيِّ أَنَّهُ أَخْبَرَهُ ، قَالَ : كُنْتُ مَعَ مُجَاهِدٍ وَهُوَ يَطُوفُ بِالْبَيْتِ فَجَاءَهُ إِنْسَانٌ فَسَأَلَهُ عَنْ صِيَامِ أَيَّامِ الْكَفَّارَةِ أَمُتَتَابِعَاتٍ أَمْ يَقْطَعُهَا ؟ قَالَ حُمَيْدٌ : فَقُلْتُ لَهُ : نَعَمْ ، يَقْطَعُهَا إِنْ شَاءَ ، قَالَ
مُجَاهِدٌ :
" لَا يَقْطَعُهَا فَإِنَّهَا فِي قِرَاءَةِ أُبَيِّ بْنِ كَعْبٍ ثَلَاثَةِ أَيَّامٍ مُتَتَابِعَاتٍ "
It is narrated from Humaid bin Qais Makki that I was with Mujahid and we were performing Tawaf of the Ka'bah. Meanwhile, a man came and asked whether the fasts of expiation should be consecutive or separate? Humaid said: Yes, he can keep them separately if he wishes. Mujahid said: No, because in the recitation of Sayyiduna Ubayy bin Ka'b (may Allah be pleased with him) it is: «ثَلٰثَةِ أَيَّامٍ مُتَتَابِعَاتٍ» meaning the fasts of three days should be consecutive.
Hadith 625B1
قَالَ مَالِك : وَأَحَبُّ إِلَيَّ أَنْ يَكُونَ مَا سَمَّى اللَّهُ فِي الْقُرْآنِ يُصَامُ مُتَتَابِعًا
Imam Malik, may Allah have mercy on him, said: Observing consecutively all the fasts that Allah, Glorious and Exalted is He, has mentioned in His Word is better.
Hadith 625B2
وَسُئِلَ مَالِك ، عَنِ الْمَرْأَةِ تُصْبِحُ صَائِمَةً فِي رَمَضَانَ ، فَتَدْفَعُ دَفْعَةً مِنْ دَمٍ عَبِيطٍ فِي غَيْرِ أَوَانِ حَيْضِهَا ، ثُمَّ تَنْتَظِرُ حَتَّى تُمْسِيَ أَنْ تَرَى مِثْلَ ذَلِكَ ، فَلَا تَرَى شَيْئًا ثُمَّ تُصْبِحُ يَوْمًا آخَرَ فَتَدْفَعُ دَفْعَةً أُخْرَى ، وَهِيَ دُونَ الْأُولَى ثُمَّ يَنْقَطِعُ ذَلِكَ عَنْهَا قَبْلَ حَيْضَتِهَا بِأَيَّامٍ ، فَسُئِلَ مَالِك : كَيْفَ تَصْنَعُ فِي صِيَامِهَا وَصَلَاتِهَا ؟ قَالَ مَالِك : ذَلِكَ الدَّمُ مِنَ الْحَيْضَةِ فَإِذَا رَأَتْهُ فَلْتُفْطِرْ ، وَلْتَقْضِ مَا أَفْطَرَتْ فَإِذَا ذَهَبَ عَنْهَا الدَّمُ فَلْتَغْتَسِلْ ، وَتَصُومُ
Imam Malik, may Allah have mercy on him, was asked about a woman who begins her fast in the morning during Ramadan, then suddenly sees blood, and it is not during her days of menstruation. She waits until evening but sees nothing further. Then the next day, when morning comes, she suddenly sees blood again, but less than the first day. Then the blood stops, and this incident occurs before her usual days of menstruation. What is the ruling regarding her fasting and prayer? Imam Malik, may Allah have mercy on him, replied: This blood is menstrual blood, so when she sees it, she should break her fast and make up that fast later. Then when the blood stops, she should perform ghusl and resume fasting.
Hadith 625B3
وَسُئِلَ عَمَّنْ أَسْلَمَ فِي آخِرِ يَوْمٍ مِنْ رَمَضَانَ ، هَلْ عَلَيْهِ قَضَاءُ رَمَضَانَ كُلِّهِ أَوْ يَجِبُ عَلَيْهِ قَضَاءُ الْيَوْمِ الَّذِي أَسْلَمَ فِيهِ ؟ فَقَالَ : لَيْسَ عَلَيْهِ قَضَاءُ مَا مَضَى وَإِنَّمَا يَسْتَأْنِفُ الصِّيَامَ فِيمَا يُسْتَقْبَلُ وَأَحَبُّ إِلَيَّ أَنْ يَقْضِيَ الْيَوْمَ الَّذِي أَسْلَمَ فِيهِ
Imam Malik, may Allah have mercy on him, was asked: If a person becomes Muslim in the evening with some days of Ramadan remaining, is it obligatory for him to make up the entire Ramadan or just the day on which he became Muslim? Imam Malik, may Allah have mercy on him, replied: It is not obligatory for him to make up the previous fasts, rather he should fast from then onwards, and if he also makes up the fast of the day on which he became Muslim, then that is better.
