بَابُ مَا جَاءَ فِي الرُّخْصَةِ فِي الْقُبْلَةِ لِلصَّائِمِ
What is reported about the concession for kissing while fasting
Hadith 590
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ عَطَاءِ بْنِ يَسَارٍ ، أَنَّ رَجُلًا قَبَّلَ امْرَأَتَهُ وَهُوَ صَائِمٌ فِي رَمَضَانَ ، فَوَجَدَ مِنْ ذَلِكَ وَجْدًا شَدِيدًا ، فَأَرْسَلَ امْرَأَتَهُ تَسْأَلُ لَهُ عَنْ ذَلِكَ فَدَخَلَتْ عَلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهَا ، فَأَخْبَرَتْهَا أُمُّ سَلَمَةَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُقَبِّلُ وَهُوَ صَائِمٌ ، فَرَجَعَتْ فَأَخْبَرَتْ زَوْجَهَا بِذَلِكَ فَزَادَهُ ذَلِكَ شَرًّا ، وَقَالَ : لَسْنَا مِثْلَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اللَّهُ يُحِلُّ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا شَاءَ ، ثُمَّ رَجَعَتِ امْرَأَتُهُ إِلَى أُمِّ سَلَمَةَ فَوَجَدَتْ عِنْدَهَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَا لِهَذِهِ الْمَرْأَةِ ؟ " فَأَخْبَرَتْهُ أُمُّ سَلَمَةَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَلَا أَخْبَرْتِيهَا أَنِّي أَفْعَلُ ذَلِكَ ؟ " فَقَالَتْ : قَدْ أَخْبَرْتُهَا فَذَهَبَتْ إِلَى زَوْجِهَا فَأَخْبَرَتْهُ فَزَادَهُ ذَلِكَ شَرًّا ، وَقَالَ : لَسْنَا مِثْلَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، اللَّهُ يُحِلُّ لِرَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا شَاءَ ، فَغَضِبَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَقَالَ : " وَاللَّهِ إِنِّي لَأَتْقَاكُمْ لِلَّهِ وَأَعْلَمُكُمْ بِحُدُودِهِ "
It is narrated from Ata bin Yasar that a man kissed his wife while he was fasting in Ramadan, so he became very distressed and sent his wife to Umm al-Mu'minin Sayyida Umm Salamah (may Allah be pleased with her) to ask her about the matter. So the woman went to Sayyida Umm Salamah (may Allah be pleased with her) and explained it to her. Sayyida Umm Salamah (may Allah be pleased with her) said: The Messenger of Allah (peace and blessings be upon him) kisses while fasting. Then she went back to her husband and informed him, and her husband became even more distressed and said: We are not like the Messenger of Allah (peace and blessings be upon him); Allah makes lawful for His Messenger whatever He wills. Then his wife came again to Sayyida Umm Salamah (may Allah be pleased with her) and saw that the Messenger of Allah (peace and blessings be upon him) was also present there. So the Messenger of Allah (peace and blessings be upon him) asked: "What is the matter with this woman?" So Sayyida Umm Salamah (may Allah be pleased with her) explained it to him. The Messenger of Allah (peace and blessings be upon him) said: "Why did you not say to him that I also do this (i.e., kiss while fasting)?" Sayyida Umm Salamah (may Allah be pleased with her) said: I did say that, but she went to her husband and informed him, so he became even more distressed and said: We are not like the Messenger of Allah (peace and blessings be upon him); Allah, Glorified and Exalted is He, makes lawful for His Messenger whatever He wills. The Messenger of Allah (peace and blessings be upon him) became angry and said: "By Allah! I am the most fearful of Allah among you and the most knowledgeable of His limits among you."
Hadith 591
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ رَضِيَ اللَّهُ عَنْهَا ، أَنَّهَا قَالَتْ : " إِنْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَيُقَبِّلُ بَعْضَ أَزْوَاجِهِ وَهُوَ صَائِمٌ " ثُمَّ ضَحِكَتْ
Umm al-Mu'minin Sayyida Aisha (may Allah be pleased with her) used to say that the Messenger of Allah (peace and blessings be upon him) would kiss some of his wives while he was fasting, and then she would laugh.
Hadith 592
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، " أَنَّ عَاتِكَةَ ابْنَةَ زَيْدِ بْنِ عَمْرِو بْنِ نُفَيْلٍ امْرَأَةَ عُمَرَ بْنِ الْخَطَّابِ كَانَتْ تُقَبِّلُ رَأْسَ عُمَرَ بْنِ الْخَطَّابِ وَهُوَ صَائِمٌ فَلَا يَنْهَاهَا "
It is narrated from Yahya bin Saeed that Sayyida Atika (may Allah be pleased with her), the wife of Sayyiduna Umar (may Allah be pleased with him), used to kiss the head of Sayyiduna Umar (may Allah be pleased with him) while he was fasting, but he did not stop her.
Hadith 593
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ أَبِي النَّضْرِ مَوْلَى عُمَرَ بْنِ عُبَيْدِ اللَّهِ ، أَنَّ عَائِشَةَ بِنْتَ طَلْحَةَ أَخْبَرَتْهُ ، أَنَّهَا كَانَتْ عِنْدَ عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَدَخَلَ عَلَيْهَا زَوْجُهَا هُنَالِكَ وَهُوَ عَبْدُ اللَّهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ الصِّدِّيقِ وَهُوَ صَائِمٌ ، فَقَالَتْ لَهُ عَائِشَةُ : مَا يَمْنَعُكَ أَنْ تَدْنُوَ مِنْ أَهْلِكَ فَتُقَبِّلَهَا وَتُلَاعِبَهَا ؟ فَقَالَ : أُقَبِّلُهَا وَأَنَا صَائِمٌ ؟ قَالَتْ : " نَعَمْ "
It is narrated from Hazrat Aisha bint Talha that she was sitting with Ummul Momineen Sayyida Aisha (may Allah be pleased with her), when her husband Abdullah bin Abdur Rahman bin Abi Bakr Siddiq (the nephew of Sayyida Aisha, may Allah be pleased with her) came and he was fasting. So Sayyida Aisha (may Allah be pleased with her) said to him: Why don’t you go to your wife? Kiss her and play with her. Abdullah said: Should I kiss her while I am fasting? Sayyida Aisha Siddiqa (may Allah be pleased with her) said: Yes.
Hadith 594
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، أَنَّ أَبَا هُرَيْرَةَ ، وَسَعْدَ بْنَ أَبِي وَقَّاصٍ ، " كَانَا يُرَخِّصَانِ فِي الْقُبْلَةِ لِلصَّائِمِ "
It is narrated from Sayyiduna Zayd bin Aslam (may Allah be pleased with him) that Sayyiduna Abu Hurairah (may Allah be pleased with him) and Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him) used to permit a fasting person to kiss.
