Hadith 133
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، عَنْ
أَبِيهِ ، عَنْ
عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهَا قَالَتْ : قَالَتْ فَاطِمَةُ بِنْتُ أَبِي حُبَيْشٍ : يَا رَسُولَ اللَّهِ ، إِنِّي لَا أَطْهُرُ أَفَأَدَعُ الصَّلَاةَ ؟ فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّمَا
ذَلِكَ عِرْقٌ ، وَلَيْسَتْ بِالْحَيْضَةِ ، فَإِذَا أَقْبَلَتِ الْحَيْضَةُ فَاتْرُكِي الصَّلَاةَ ، فَإِذَا ذَهَبَ قَدْرُهَا فَاغْسِلِي الدَّمَ عَنْكِ وَصَلِّي "
It is narrated from Sayyida Aisha Siddiqa (may Allah be pleased with her) that Sayyida Fatima bint Abi Hubaysh (may Allah be pleased with her) said: O Messenger of Allah (peace and blessings be upon him)! I do not become pure, so should I leave the prayer? He (peace and blessings be upon him) said: "This blood is from a vein and is not menstruation, so when menstruation comes, leave the prayer, then when the period passes, wash the blood and perform the prayer."
Hadith 134
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
نَافِعٍ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ
أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ امْرَأَةً كَانَتْ تُهَرَاقُ الدِّمَاءَ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاسْتَفْتَتْ لَهَا أُمُّ سَلَمَةَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ :
" لِتَنْظُرْ إِلَى عَدَدِ اللَّيَالِي وَالْأَيَّامِ الَّتِي كَانَتْ تَحِيضُهُنَّ مِنَ الشَّهْرِ قَبْلَ أَنْ يُصِيبَهَا الَّذِي أَصَابَهَا ، فَلْتَتْرُكِ الصَّلَاةَ قَدْرَ ذَلِكَ مِنَ الشَّهْرِ ، فَإِذَا خَلَّفَتْ ذَلِكَ فَلْتَغْتَسِلْ ثُمَّ لِتَسْتَثْفِرْ بِثَوْبٍ ، ثُمَّ لِتُصَلِّي "
It is narrated from Sayyida Umm Salama (may Allah be pleased with her) that there was a woman who used to have continuous bleeding during the time of the Messenger of Allah (peace be upon him). Umm Salama (may Allah be pleased with her) asked the Prophet (peace be upon him) for a ruling on her behalf. The Prophet (peace be upon him) said: "She should count the days and nights in which she used to have her menstrual period before this illness, and leave the prayer for that duration each month. Then, when that period has passed, she should perform ghusl (ritual bath), tie a cloth over her private part, and then perform the prayer."
Hadith 135
Zaynab bint Abi Salamah narrates that she saw Lady Zaynab bint Jahsh, may Allah be pleased with her, who was married to Sayyiduna Abdur Rahman bin Awf, may Allah be pleased with him. She had istihada (non-menstrual bleeding) and she would perform ghusl and then pray.
Hadith 136
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
سُمَيٍّ مَوْلَى أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ ، أَنَّ الْقَعْقَاعَ بْنَ حَكِيمٍ ، وَزَيْدَ بْنَ أَسْلَمَ أَرْسَلَاهُ إِلَى
سَعِيدِ بْنِ الْمُسَيَّبِ يَسْأَلُهُ كَيْفَ تَغْتَسِلُ الْمُسْتَحَاضَةُ ؟ فَقَالَ :
" تَغْتَسِلُ مِنْ طُهْرٍ إِلَى طُهْرٍ ، وَتَتَوَضَّأُ لِكُلِّ صَلَاةٍ ، فَإِنْ غَلَبَهَا الدَّمُ اسْتَثْفَرَتْ "
Sumi reports that Qaqa’ bin Hakim and Zaid bin Aslam sent Sumi to Sa’id bin al-Musayyib to ask him how a woman with istihada (non-menstrual bleeding) should perform ghusl. Sa’id said: She should perform ghusl from one period of purity to the next, and perform wudu for every prayer. If there is a lot of blood, she should tie a cloth over her private part.
Hadith 137
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، عَنْ
أَبِيهِ ، أَنَّهُ قَالَ :
" لَيْسَ عَلَى الْمُسْتَحَاضَةِ إِلَّا أَنْ تَغْتَسِلَ غُسْلًا وَاحِدًا ثُمَّ تَتَوَضَّأُ بَعْدَ ذَلِكَ لِكُلِّ صَلَاةٍ " . ¤ قَالَ يَحْيَى : قَالَ مَالِك : الْأَمْرُ عِنْدَنَا أَنَّ الْمُسْتَحَاضَةَ إِذَا صَلَّتْ أَنَّ لِزَوْجِهَا أَنْ يُصِيبَهَا ، وَكَذَلِكَ النُّفَسَاءُ إِذَا بَلَغَتْ أَقْصَى مَا يُمْسِكُ النِّسَاءَ الدَّمُ ، فَإِنْ رَأَتِ الدَّمَ بَعْدَ ذَلِكَ فَإِنَّهُ يُصِيبُهَا زَوْجُهَا وَإِنَّمَا هِيَ بِمَنْزِلَةِ الْمُسْتَحَاضَةِ . قَالَ يَحْيَى . قَالَ مَالِك : الْأَمْرُ عِنْدَنَا فِي الْمُسْتَحَاضَةِ عَلَى حَدِيثِ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، وَهُوَ أَحَبُّ مَا سَمِعْتُ إِلَيَّ فِي ذَلِكَ
It is narrated from Hazrat Urwah bin Zubair, he said: For a woman experiencing istihada (non-menstrual vaginal bleeding), there is only one ghusl (ritual bath), then she should perform wudu (ablution) for every prayer.
Imam Malik, may Allah have mercy on him, said: According to us, the ruling is that when a woman experiencing istihada is about to pray, her husband is also permitted to have intercourse with her. Similarly, for a woman in nifas (postnatal bleeding), if blood continues until the end of the prescribed period and she sees blood after that as well, her husband may have intercourse with her, and this blood is also considered as istihada.
Imam Malik, may Allah have mercy on him, said: According to us, the ruling for a woman experiencing istihada is in accordance with the hadith of Urwah, which Urwah narrated from Sayyida Aisha, may Allah be pleased with her, who narrated from the Prophet, peace and blessings be upon him, which has already been mentioned at the beginning of the chapter. Of all the narrations I have heard in this chapter, I prefer that narration the most.
