بَابُ الطَّهُورِ لِلْوُضُوءِ
Chapter on purification for ablution
Hadith 40
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ صَفْوَانَ بْنِ سُلَيْمٍ ، عَنْ سَعِيدِ بْنِ سَلَمَةَ مِنْ آلِ بَنِي الْأَزْرَقِ ، عَنْ الْمُغِيرَةِ بْنِ أَبِي بُرْدَةَ وَهُوَ مِنْ بَنِي عَبْدِ الدَّارِ ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ ، يَقُولُ : جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنَّا نَرْكَبُ الْبَحْرَ وَنَحْمِلُ مَعَنَا الْقَلِيلَ مِنَ الْمَاءِ ، فَإِنْ تَوَضَّأْنَا بِهِ عَطِشْنَا أَفَنَتَوَضَّأُ بِهِ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " هُوَ الطَّهُورُ مَاؤُهُ ، الْحِلُّ مَيْتَتُهُ "
It is narrated from Sayyiduna Abu Huraira (may Allah be pleased with him) that a man came to the Messenger of Allah (peace and blessings be upon him) and said: O Messenger of Allah (peace and blessings be upon him)! We travel by sea and carry only a little water with us. If we use it for ablution, we will be left thirsty. Can we perform ablution with the water of the sea? The Prophet (peace and blessings be upon him) replied: "Its water is pure, and its dead (animals) are lawful."
Hadith 41
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ إِسْحَاق بْنِ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ ، عَنْ حُمَيْدَةَ بِنْتِ أَبِي عُبَيْدَةَ عُبَيْدِ بْنِ فَرْوَةَ ، عَنْ خَالَتِهَا كَبْشَةَ بِنْتِ كَعْبِ بْنِ مَالِكٍ ، وَكَانَتْ تَحْتَ ابْنِ أَبِي قَتَادَةَ الْأَنْصَارِيِّ ، أَنَّهَا أَخْبَرَتْهَا ، أَنَّ أَبَا قَتَادَةَ دَخَلَ عَلَيْهَا فَسَكَبَتْ لَهُ وَضُوءًا ، فَجَاءَتْ هِرَّةٌ لِتَشْرَبَ مِنْهُ ، فَأَصْغَى لَهَا الْإِنَاءَ حَتَّى شَرِبَتْ ، قَالَتْ كَبْشَةُ : فَرَآنِي أَنْظُرُ إِلَيْهِ ، فَقَالَ : أَتَعْجَبِينَ يَا ابْنَةَ أَخِي ؟ قَالَتْ : فَقُلْتُ : نَعَمْ ، فَقَالَ : إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِنَّهَا لَيْسَتْ بِنَجَسٍ ، إِنَّمَا هِيَ مِنَ الطَّوَّافِينَ عَلَيْكُمْ أَوِ الطَّوَّافَاتِ " . ¤ قَالَ يَحْيَى : قَالَ مَالِك : لَا بَأْسَ بِهِ إِلَّا أَنْ يُرَى عَلَى فَمِهَا نَجَاسَةٌ
It is narrated from Kabsha bint Ka'b that Sayyiduna Abu Qatadah Ansari (may Allah be pleased with him) came to her, so Kabsha placed a vessel of water for his ablution. Then a cat came to drink from it, so Sayyiduna Abu Qatadah (may Allah be pleased with him) tilted the vessel for the cat until it drank the water. Kabsha said: Sayyiduna Abu Qatadah (may Allah be pleased with him) saw that I was looking at him with astonishment, so Sayyiduna Abu Qatadah (may Allah be pleased with him) asked: Are you surprised, O my niece? I said: Yes. So Sayyiduna Abu Qatadah (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) said: "The cat is not impure; it is among those who go around among you frequently, by night and by day."
Imam Malik (may Allah have mercy on him) said: There is no harm in the leftover water of a cat, except if impurity is seen on its mouth.

Hadith 42
وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ بْنِ الْحَارِثِ التَّيْمِيِّ ، عَنْ يَحْيَى بْنِ عَبْدِ الرَّحْمَنِ بْنِ حَاطِبٍ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ خَرَجَ فِي رَكْبٍ فِيهِمْ عَمْرُو بْنُ الْعَاصِ حَتَّى وَرَدُوا حَوْضًا ، فَقَالَ عَمْرُو بْنُ الْعَاصِ لِصَاحِبِ الْحَوْضِ : يَا صَاحِبَ الْحَوْضِ ، هَلْ تَرِدُ حَوْضَكَ السِّبَاعُ ؟ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ : " يَا صَاحِبَ الْحَوْضِ ، لَا تُخْبِرْنَا ، فَإِنَّا نَرِدُ عَلَى السِّبَاعِ ، وَتَرِدُ عَلَيْنَا "
Yahya bin Abdur Rahman narrates that Sayyiduna Umar bin Khattab (may Allah be pleased with him) went out with a group of riders, among whom was Sayyiduna Amr bin As (may Allah be pleased with him) as well. On the way, they came across a reservoir, so Sayyiduna Amr bin As (may Allah be pleased with him) asked the owner of the reservoir, "Do wild animals come to your reservoir to drink water?" Upon this, Sayyiduna Umar bin Khattab (may Allah be pleased with him) said, "O owner of the reservoir! Do not tell us, because sometimes the wild animals come before us and sometimes we come before the wild animals."
Hadith 43
وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ نَافِعٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يَقُولُ : " إِنْ كَانَ الرِّجَالُ وَالنِّسَاءُ فِي زَمَانِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَيَتَوَضَّئُونَ جَمِيعًا "
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say that men and women used to perform ablution together during the time of the Messenger of Allah (peace and blessings be upon him).
