وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
ابْنِ شِهَابٍ ، عَنْ
أَنَسِ بْنِ مَالِكٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دَخَلَ مَكَّةَ عَامَ الْفَتْحِ، وَعَلَى رَأْسِهِ الْمِغْفَرُ، فَلَمَّا نَزَعَهُ جَاءَهُ رَجُلٌ، فَقَالَ لَهُ : يَا رَسُولَ اللَّهِ،
ابْنُ خَطَلٍ مُتَعَلِّقٌ بِأَسْتَارِ الْكَعْبَةِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اقْتُلُوهُ " .¤ قَالَ مَالِك : وَلَمْ يَكُنْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَئِذٍ مُحْرِمًا وَاللَّهُ أَعْلَمُ
It is narrated from Sayyiduna Anas bin Malik (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) entered Makkah in the year Makkah was conquered, and there was a helmet on his head. When he (peace and blessings be upon him) removed the helmet, a man came and said, "O Messenger of Allah (peace and blessings be upon him)! Ibn Khatal (he was a disbeliever whose name was ‘Abdul ‘Uzza; the Prophet, peace and blessings be upon him, had made his blood permissible) is hanging onto the curtains of the Ka‘bah." The Prophet (peace and blessings be upon him) said: "Kill him."
Imam Malik (may Allah have mercy on him) said: The Messenger of Allah (peace and blessings be upon him) was not in the state of Ihram that day.
