Hadith 875B

قَالَ مَالِك، فِي الْعَبْدِ يُعْتَقُ فِي الْمَوْقِفِ بِعَرَفَةَ : فَإِنَّ ذَلِكَ لَا يُجْزِي عَنْهُ مِنْ حَجَّةِ الْإِسْلَامِ، إِلَّا أَنْ يَكُونَ لَمْ يُحْرِمْ، فَيُحْرِمُ بَعْدَ أَنْ يُعْتَقَ، ثُمَّ يَقِفُ بِعَرَفَةَ مِنْ تِلْكَ اللَّيْلَةِ قَبْلَ أَنْ يَطْلُعَ الْفَجْرُ، فَإِنْ فَعَلَ ذَلِكَ أَجْزَأَ عَنْهُ، وَإِنْ لَمْ يُحْرِمْ حَتَّى طَلَعَ الْفَجْرُ كَانَ بِمَنْزِلَةِ مَنْ فَاتَهُ الْحَجُّ، إِذَا لَمْ يُدْرِكِ الْوُقُوفَ بِعَرَفَةَ قَبْلَ طُلُوعِ الْفَجْرِ مِنْ لَيْلَةِ الْمُزْدَلِفَةِ، وَيَكُونُ عَلَى الْعَبْدِ حَجَّةُ الْإِسْلَامِ يَقْضِيهَا
Imam Malik, may Allah have mercy on him, said: If a slave is freed at Arafat, this will not be his obligatory Hajj unless he has not yet assumed Ihram, and if after being freed he assumes Ihram and stays at Arafat before the dawn of the Day of Sacrifice, then his obligatory Hajj will be fulfilled. If he does not assume Ihram until the break of dawn, then his example is like that of someone whose Hajj has lapsed and who did not attain the standing at Arafat until the dawn of the night of Muzdalifah; thus, it will remain obligatory upon this slave to perform the obligatory Hajj.
