Hadith 870

وَحَدَّثَنِي، عَنْ مَالِك، أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ، يَقُولُ : لَا يَشْتَرِكُ الرَّجُلُ وَامْرَأَتُهُ فِي بَدَنَةٍ وَاحِدَةٍ لِيُهْدِ كُلُّ وَاحِدٍ مِنْهُمَا بَدَنَةً بَدَنَةً ¤
Imam Malik, may Allah have mercy on him, heard from some people of knowledge, who used to say that a man and his wife cannot share one camel; rather, each of them must have a separate camel.
قَالَ يَحْيَى : وَسُئِلَ مَالِك عَمَّنْ بُعِثَ مَعَهُ بِهَدْيٍ، يَنْحَرُهُ فِي حَجٍّ وَهُوَ مُهِلٌّ بِعُمْرَةٍ، هَلْ يَنْحَرُهُ إِذَا حَلَّ، أَمْ يُؤَخِّرُهُ حَتَّى يَنْحَرَهُ فِي الْحَجِّ، وَيُحِلُّ هُوَ مِنْ عُمْرَتِهِ ؟ فَقَالَ : بَلْ يُؤَخِّرُهُ حَتَّى يَنْحَرَهُ فِي الْحَجِّ، وَيُحِلُّ هُوَ مِنْ عُمْرَتِهِ .
Imam Malik, may Allah have mercy on him, was asked: If a sacrificial animal (hadi) is sent with a person so that he may slaughter it during Hajj, and that person assumes ihram for Umrah, should he slaughter the hadi when he completes his Umrah, or should he delay its slaughtering until Hajj? He replied: He should delay the slaughtering of the hadi, and slaughter it during Hajj, and he should perform Umrah and exit ihram.
قَالَ مَالِك : وَالَّذِي يُحْكَمُ عَلَيْهِ بِالْهَدْيِ فِي قَتْلِ الصَّيْدِ، أَوْ يَجِبُ عَلَيْهِ هَدْيٌ فِي غَيْرِ ذَلِكَ، فَإِنَّ هَدْيَهُ لَا يَكُونُ إِلَّا بِمَكَّةَ كَمَا قَالَ اللَّهُ تَبَارَكَ وَتَعَالَى : «هَدْيًا بَالِغَ الْكَعْبَةِ » (سورة المائدة آية 95) وَأَمَّا مَا عُدِلَ بِهِ الْهَدْيُ مِنَ الصِّيَامِ أَوِ الصَّدَقَةِ، فَإِنَّ ذَلِكَ يَكُونُ بِغَيْرِ مَكَّةَ حَيْثُ أَحَبَّ صَاحِبُهُ، أَنْ يَفْعَلَهُ فَعَلَهُ
Imam Malik, may Allah have mercy on him, said: Whoever is required to offer a sacrificial animal (hady) as a penalty for hunting, or for any other reason that makes the hady obligatory upon him, he should bring the hady to Mecca, as Allah the Exalted has said: «﴿هَدْيًا بَالِغَ الْكَعْبَةِ﴾» (5-al-Ma'idah:95), meaning "a sacrificial animal that reaches the Ka'bah." And whoever is required to fast or give charity in place of hunting or in place of the hady, then he has the choice to fast wherever he wishes, or to give charity either in the Haram or outside the Haram.
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ نَافِعٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يَقُولُ : " الْمَرْأَةُ الْمُحْرِمَةُ إِذَا حَلَّتْ لَمْ تَمْتَشِطْ حَتَّى تَأْخُذَ مِنْ قُرُونِ رَأْسِهَا، وَإِنْ كَانَ لَهَا هَدْيٌ لَمْ تَأْخُذْ مِنْ شَعْرِهَا شَيْئًا حَتَّى تَنْحَرَ هَدْيَهَا " .
It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: A woman who has entered into ihram should not comb her hair when she comes out of ihram until she has had her hair locks cut, and the one who has a sacrificial animal with her should not cut her hair until the sacrificial animal has been slaughtered.
