قَالَ مَالِك : وَالَّذِي يُفْسِدُ الْحَجَّ أَوِ الْعُمْرَةَ، حَتَّى يَجِبَ عَلَيْهِ فِي ذَلِكَ الْهَدْيُ فِي الْحَجِّ أَوِ الْعُمْرَةِ، الْتِقَاءُ الْخِتَانَيْنِ، وَإِنْ لَمْ يَكُنْ مَاءٌ دَافِقٌ، قَالَ : وَيُوجِبُ ذَلِكَ أَيْضًا الْمَاءُ الدَّافِقُ إِذَا كَانَ مِنْ مُبَاشَرَةٍ، فَأَمَّا رَجُلٌ ذَكَرَ شَيْئًا حَتَّى خَرَجَ مِنْهُ مَاءٌ دَافِقٌ، فَلَا أَرَى عَلَيْهِ شَيْئًا .
Imam Malik, may Allah have mercy on him, said that Hajj or Umrah becomes invalidated by intercourse in which penetration occurs, even if ejaculation does not take place. And if ejaculation occurs through intimacy without penetration, even then the Hajj becomes invalid. However, if a person merely had a thought in his heart and ejaculation occurred, then nothing is obligatory upon him.
