حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّهُ بَلَغَهُ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، وَعَلِيَّ بْنَ أَبِي طَالِبٍ، وَأَبَا هُرَيْرَةَ سُئِلُوا عَنْ رَجُلٍ أَصَابَ أَهْلَهُ وَهُوَ مُحْرِمٌ بِالْحَجِّ، فَقَالُوا : " يَنْفُذَانِ يَمْضِيَانِ لِوَجْهِهِمَا حَتَّى يَقْضِيَا حَجَّهُمَا، ثُمَّ عَلَيْهِمَا حَجُّ قَابِلٍ وَالْهَدْيُ "، قَالَ : وَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ : " وَإِذَا أَهَلَّا بِالْحَجِّ مِنْ عَامٍ قَابِلٍ تَفَرَّقَا، حَتَّى يَقْضِيَا حَجَّهُمَا "
Imam Malik (may Allah have mercy on him) was informed that Sayyiduna Umar bin Khattab (may Allah be pleased with him), Sayyiduna Ali bin Abi Talib (may Allah be pleased with him), and Sayyiduna Abu Hurairah (may Allah be pleased with him) were asked about a man who had intercourse with his wife while in the state of ihram; what should he do? All of them replied that both the husband and wife should complete the rites of Hajj until the Hajj is finished, then in the following year, Hajj and offering a sacrifice (hady) are obligatory upon them. Sayyiduna Ali (may Allah be pleased with him) also said that then in the following year, when they perform Hajj, both should remain separate from each other until the Hajj is completed.
