Hadith 830

وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ هِشَامِ بْنِ عُرْوَةَ ، أَنَّ سَوْدَةَ بِنْتَ عَبْدِ اللَّهِ بْنِ عُمَرَ كَانَتْ عِنْدَ عُرْوَةَ بْنِ الزُّبَيْرِ، فَخَرَجَتْ تَطُوفُ بَيْنَ الصَّفَا، وَالْمَرْوَةِ فِي حَجٍّ أَوْ عُمْرَةٍ مَاشِيَةً، وَكَانَتِ امْرَأَةً ثَقِيلَةً، فَجَاءَتْ حِينَ انْصَرَفَ النَّاسُ مِنَ الْعِشَاءِ، فَلَمْ تَقْضِ طَوَافَهَا حَتَّى نُودِيَ بِالْأُولَى مِنَ الصُّبْحِ، فَقَضَتْ طَوَافَهَا فِيمَا بَيْنَهَا وَبَيْنَهُ، وَكَانَ عُرْوَةُ إِذَا رَآهُمْ يَطُوفُونَ عَلَى الدَّوَابِّ يَنْهَاهُمْ أَشَدَّ النَّهْيِ . فَيَعْتَلُّونَ بِالْمَرَضِ حَيَاءً مِنْهُ، فَيَقُولُ لَنَا، فِيمَا بَيْنَنَا وَبَيْنَهُ : " لَقَدْ خَابَ هَؤُلَاءِ وَخَسِرُوا " .
It is narrated from Hisham bin Urwah that Sawdah, the daughter of Abdullah bin Umar (may Allah be pleased with them), was married to Urwah bin Zubair. One day she went out to perform Sa'i between Safa and Marwah, on foot, during Hajj or Umrah, and she was a stout woman. She went to perform Sa'i when people had finished the Isha prayer, and her Sa'i was not yet complete when the call to prayer for Fajr was given. Then she completed her Sa'i in that interval. And whenever Urwah saw people performing Sa'i while riding, he would strictly forbid them. Those people would make the excuse of illness out of shyness from Urwah. So Urwah would say among his people: These people have suffered loss, they did not attain the objective.
وَسُئِلَ مَالِك، عَنِ الرَّجُلِ يَلْقَاهُ الرَّجُلُ بَيْنَ الصَّفَا، وَالْمَرْوَةِ، فَيَقِفُ مَعَهُ يُحَدِّثُهُ، فَقَالَ : لَا أُحِبُّ لَهُ ذَلِكَ ¤
Imam Malik, may Allah have mercy on him, was asked about a person who, while performing Sa'i, stands and starts talking to someone; what is the ruling on this? He replied: I do not like this.
قَالَ مَالِك : وَمَنْ نَسِيَ مِنْ طَوَافِهِ شَيْئًا، أَوْ شَكَّ فِيهِ، فَلَمْ يَذْكُرْ إِلَّا وَهُوَ يَسْعَى بَيْنَ الصَّفَا، وَالْمَرْوَةِ، فَإِنَّهُ يَقْطَعُ سَعْيَهُ، ثُمَّ يُتِمُّ طَوَافَهُ بِالْبَيْتِ عَلَى مَا يَسْتَيْقِنُ، وَيَرْكَعُ رَكْعَتَيِ الطَّوَافِ، ثُمَّ يَبْتَدِئُ سَعْيَهُ بَيْنَ الصَّفَا، وَالْمَرْوَةِ ¤
Imam Malik, may Allah have mercy on him, said: If a person forgets a circuit during Tawaf, or he becomes doubtful about it, and then remembers it while performing Sa’i, he should stop the Sa’i and first complete the Tawaf, and perform the two units of prayer for Tawaf, then start the Sa’i from the beginning.
قَالَ مَالِك : مَنْ نَسِيَ السَّعْيَ بَيْنَ الصَّفَا، وَالْمَرْوَةِ فِي عُمْرَةٍ، فَلَمْ يَذْكُرْ حَتَّى يَسْتَبْعِدَ مِنْ مَكَّةَ، أَنَّهُ يَرْجِعُ، فَيَسْعَى، وَإِنْ كَانَ قَدْ أَصَابَ النِّسَاءَ، فَلْيَرْجِعْ، فَلْيَسْعَ بَيْنَ الصَّفَا، وَالْمَرْوَةِ حَتَّى يُتِمَّ مَا بَقِيَ عَلَيْهِ مِنْ تِلْكَ الْعُمْرَةِ، ثُمَّ عَلَيْهِ عُمْرَةٌ أُخْرَى، وَالْهَدْيُ .
Imam Malik, may Allah have mercy on him, said that if a person forgets to perform Sa'i between Safa and Marwah during Umrah, and does not remember until he has gone far from Makkah, then he should return and perform Sa'i. And if he has had intercourse with a woman, then he should return, perform Sa'i, then perform another Umrah and offer a sacrifice.
