فَإِنْ كَانَ مِنْ غَيْرِ أَهْلِ مَكَّةَ فَأَصَابَهُ مَرَضٌ حَالَ بَيْنَهُ وَبَيْنَ الْحَجِّ ، فَطَافَ بِالْبَيْتِ وَسَعَى بَيْنَ الصَّفَا ، وَالْمَرْوَةِ حَلَّ بِعُمْرَةٍ وَطَافَ بِالْبَيْتِ طَوَافًا آخَرَ وَسَعَى بَيْنَ الصَّفَا ، وَالْمَرْوَةِ لِأَنَّ طَوَافَهُ الْأَوَّلَ وَسَعْيَهُ إِنَّمَا كَانَ نَوَاهُ لِلْحَجِّ وَعَلَيْهِ حَجُّ قَابِلٍ وَالْهَدْيُ
Imam Malik, may Allah have mercy on him, said: If a person is not a resident of Mecca and is unable to perform Hajj due to illness, and he has already performed Tawaf and Sa’i, then he should perform Umrah and exit the state of Ihram. However, he must perform Tawaf and Sa’i again for Umrah, because the first Tawaf and Sa’i were not related to Umrah, but were intended for Hajj. Now, he should perform Hajj the following year and offer a sacrificial animal (hady).
