بَابُ مَا جَاءَ فِيمَنْ أُحْصِرَ بِغَيْرِ عَدُوٍّWhat is Reported Regarding One Prevented by Other Than an Enemy
Hadith 803B6
قَالَ مَالِك فِيمَنْ أَهَلَّ بِالْحَجِّ مِنْ مَكَّةَ ، ثُمَّ طَافَ بِالْبَيْتِ وَسَعَى بَيْنَ الصَّفَا ، وَالْمَرْوَةِ ثُمَّ مَرِضَ فَلَمْ يَسْتَطِعْ أَنْ يَحْضُرَ مَعَ النَّاسِ الْمَوْقِفَ ، قَالَ مَالِك : إِذَا فَاتَهُ الْحَجُّ فَإِنِ اسْتَطَاعَ خَرَجَ إِلَى الْحِلِّ ، فَدَخَلَ بِعُمْرَةٍ فَطَافَ بِالْبَيْتِ وَسَعَى بَيْنَ الصَّفَا ، وَالْمَرْوَةِ لِأَنَّ الطَّوَافَ الْأَوَّلَ لَمْ يَكُنْ نَوَاهُ لِلْعُمْرَةِ ، فَلِذَلِكَ يَعْمَلُ بِهَذَا وَعَلَيْهِ حَجُّ قَابِلٍ وَالْهَدْيُ
Imam Malik, may Allah have mercy on him, said: If a person enters into the state of ihram for Hajj from Mecca, then performs tawaf of the Ka'bah and sa'i between Safa and Marwah, and after that becomes ill and is unable to go to Arafat with the people, then when his Hajj is missed, if possible, he should leave the Haram, enter into ihram for 'Umrah, come to Mecca, perform tawaf and sa'i, and then exit the state of ihram, because the first tawaf and sa'i were not for 'Umrah. Then, in the following year, he should perform Hajj and offer a sacrificial animal.
