Hadith 786

وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ ، أَنَّهَا قَالَتْ لَهُ : " يَا ابْنَ أُخْتِي إِنَّمَا هِيَ عَشْرُ لَيَالٍ فَإِنْ تَخَلَّجَ فِي نَفْسِكَ شَيْءٌ فَدَعْهُ " تَعْنِي أَكْلَ لَحْمِ الصَّيْدِ
Umm al-Mu'mineen Sayyidah Aisha (may Allah be pleased with her) said to Urwah bin Zubair: O son of my brother! These are the ten nights of Ihram. If you have any doubt in your heart, then completely abstain from the meat of game.
قَالَ مَالِك فِي الرَّجُلِ الْمُحْرِمِ يُصَادُ مِنْ أَجْلِهِ صَيْدٌ ، فَيُصْنَعُ لَهُ ذَلِكَ الصَّيْدُ فَيَأْكُلُ مِنْهُ وَهُوَ يَعْلَمُ أَنَّهُ مِنْ أَجْلِهِ صِيدَ : فَإِنَّ عَلَيْهِ جَزَاءَ ذَلِكَ الصَّيْدِ كُلِّهِ
Imam Malik, may Allah have mercy on him, said that if game is hunted for the sake of a muhrim, and he eats it knowing that it was hunted for him, then its penalty is obligatory upon him.
وَسُئِلَ مَالِك ، عَنِ الرَّجُلِ يُضْطَرُّ إِلَى أَكْلِ الْمَيْتَةِ وَهُوَ مُحْرِمٌ ، أَيَصِيدُ الصَّيْدَ فَيَأْكُلُهُ أَمْ يَأْكُلُ الْمَيْتَةَ ؟ فَقَالَ : بَلْ يَأْكُلُ الْمَيْتَةَ ، وَذَلِكَ أَنَّ اللَّهَ تَبَارَكَ وَتَعَالَى لَمْ يُرَخِّصْ لِلْمُحْرِمِ فِي أَكْلِ الصَّيْدِ ، وَلَا فِي أَخْذِهِ فِي حَالٍ مِنَ الْأَحْوَالِ ، وَقَدْ أَرْخَصَ فِي الْمَيْتَةِ عَلَى حَالِ الضَّرُورَةِ
Imam Malik, may Allah have mercy on him, was asked: If a person is in such a state of necessity that carrion becomes lawful for him, and he is in the state of ihram, should he hunt and eat or eat carrion? Imam Malik, may Allah have mercy on him, replied: He should eat carrion, because Allah, Glorious and Exalted is He, has not given permission to the muhrim (one in ihram) to hunt in any situation, but has given permission to eat carrion at the time of necessity.
قَالَ مَالِك : وَأَمَّا مَا قَتَلَ الْمُحْرِمُ أَوْ ذَبَحَ مِنَ الصَّيْدِ ، فَلَا يَحِلُّ أَكْلُهُ لِحَلَالٍ وَلَا لِمُحْرِمٍ ، لِأَنَّهُ لَيْسَ بِذَكِيٍّ كَانَ خَطَأً أَوْ عَمْدًا فَأَكْلُهُ لَا يَحِلُّ ، وَقَدْ سَمِعْتُ ذَلِكَ مِنْ غَيْرِ وَاحِدٍ
Imam Malik, may Allah have mercy on him, said: The game that is killed or slaughtered, its eating is not permissible for anyone, neither for the Muhrim nor for the Halal, because it has not been properly slaughtered. It makes no difference whether it was killed by mistake or intentionally, in no case is it permissible. Imam Malik, may Allah have mercy on him, said: I have heard this issue from many people.
وَالَّذِي يَقْتُلُ الصَّيْدَ ثُمَّ يَأْكُلُهُ إِنَّمَا عَلَيْهِ كَفَّارَةٌ وَاحِدَةٌ ، مِثْلُ مَنْ قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُ
Imam Malik, may Allah have mercy on him, said: Whoever hunts and eats the game, then only one expiation is required of him, just like the person who hunts but does not eat.
قَالَ مَالِكٌ : كُلُّ شَيْءٍ صِيدَ فِي الْحَرَمِ ، أَوْ أُرْسِلَ عَلَيْهِ كَلْبٌ فِي الْحَرَمِ ، فَقُتِلَ ذَلِكَ الصَّيْدُ فِي الْحِلِّ ، فَإِنَّهُ لَا يَحِلُّ أَكْلُهُ. وَعَلَى مَنْ فَعَلَ ذَلِكَ جَزَاءُ الصَّيْدِ. فَأَمَّا الَّذِي يُرْسِلُ كَلْبَهُ عَلَى الصَّيْدِ فِي الْحِلِّ. فَيَطْلُبُهُ حَتَّى يَصِيدَهُ فِي الْحَرَمِ. فَإِنَّهُ لَا يُؤْكَلُ ، وَلَيْسَ عَلَيْهِ فِي ذَلِكَ جَزَاءٌ. إِلَّا أَنْ يَكُونَ أَرْسَلَهُ عَلَيْهِ ، وَهُوَ قَرِيبٌ مِنَ الْحَرَمِ فَإِنْ أَرْسَلَهُ قَرِيبًا مِنَ الْحَرَمِ فَعَلَيْهِ جَزَاؤُهُ.
Imam Malik, may Allah have mercy on him, said that if an animal is hunted in the Haram, or a hunting dog is released on game in the Haram but it kills it in the Hil, then eating that game is not lawful, and whoever does so is liable for compensation. But if someone releases a dog on game in the Hil and it takes it into the Haram and kills it there, eating it is not permissible, but compensation will not be required, except in the case where the dog was released near the Haram; in that case, compensation will be required.
قَالَ مَالِكٌ : قَالَ اللّٰهُ تَبَارَكَ وَتَعَالَى ﴿يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ. وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا. فَجَزَاءُ مِثْلِ مَا قَتَلَ مِنَ النَّعَمِ يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ، هَدْيًا بَالِغَ الْكَعْبَةِ ، أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ ، أَوْ عَدْلُ ذَلِكَ صِيَامًا لِيَذُوقَ وَبَالَ أَمْرِهِ﴾ [المائدة: 95]
Imam Malik, may Allah have mercy on him, said: Allah, Glorious and Exalted is He, said: "O you who believe! Do not kill game while you are in the state of ihram, and whoever among you kills it intentionally, then the penalty is an animal of the like of what he killed, as judged by two just men among you, as an offering brought to the Ka'bah, or as an expiation, feeding the poor or its equivalent in fasting, so that he may taste the consequence of his deed."
قَالَ مَالِكٌ : فَالَّذِي يَصِيدُ الصَّيْدَ وَهُوَ حَلَالٌ. ثُمَّ يَقْتُلُهُ وَهُوَ مُحْرِمٌ. بِمَنْزِلَةِ الَّذِي يَبْتَاعُهُ وَهُوَ مُحْرِمٌ. ثُمَّ يَقْتُلُهُ. وَقَدْ نَهَى اللّٰهُ عَنْ قَتْلِهِ. فَعَلَيْهِ جَزَاؤُهُ
Imam Malik, may Allah have mercy on him, said: If a person hunts and it is lawful, then he kills it while in the state of ihram, it is as if a muhrim buys the game and then kills it. Allah has forbidden its killing, so its compensation becomes obligatory upon him.
وَالْأَمْرُ عِنْدَنَا أَنَّ مَنْ أَصَابَ الصَّيْدَ وَهُوَ مُحْرِمٌ حُكِمَ عَلَيْهِ
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that whoever hunts while in the state of ihram, the judgment of compensation will be imposed upon him.
قَالَ مَالِكٌ : سَمِعْتُ أَنَّهُ يُحْكَمُ عَلَى مَنْ قَتَلَ الصَّيْدَ فِي الْحَرَمِ وَهُوَ حَلَالٌ ، بِمِثْلِ مَا يُحْكَمُ بِهِ عَلَى الْمُحْرِمِ الَّذِي يَقْتُلُ الصَّيْدَ فِي الْحَرَمِ وَهُوَ مُحْرِمٌ
Imam Malik, may Allah have mercy on him, said: Whoever hunts game in the Haram and it is lawful, then its ruling is the same as that of one who hunts game in the Haram while in the state of Ihram.
قَالَ مَالِكٌ : أَحْسَنُ مَا سَمِعْتُ فِي الَّذِي يَقْتُلُ الصَّيْدَ فَيُحْكَمُ عَلَيْهِ فِيهِ ، أَنْ يُقَوَّمَ الصَّيْدُ الَّذِي أَصَابَ ، فَيُنْظَرَ كَمْ ثَمَنُهُ مِنَ الطَّعَامِ ، فَيُطْعِمَ كُلَّ مِسْكِينٍ مُدًّا. أَوْ يَصُومَ مَكَانَ كُلِّ مُدٍّ يَوْمًا. وَيُنْظَرَ كَمْ عِدَّةُ الْمَسَاكِينِ. فَإِنْ كَانُوا عَشَرَةً صَامَ عَشَرَةَ أَيَّامٍ ، وَإِنْ كَانُوا عِشْرِينَ مِسْكِينًا صَامَ عِشْرِينَ يَوْمًا عَدَدَهُمْ مَا كَانُوا ، وَإِنْ كَانُوا أَكْثَرَ مِنْ سِتِّينَ مِسْكِينًا
Imam Malik, may Allah have mercy on him, said: I have heard very well in this chapter that if a person hunts, then the value of that game will be assessed, and it will be calculated how much grain comes from its value. So, he should give each mudd to a poor person, or for each mudd, he should fast one day, and look at the number of the poor. If they are ten, then ten fasts; and if they are twenty, then twenty fasts. Even if it exceeds sixty poor people.
