بَابُ مَا جَاءَ فِي أَخْذِ الصَّدَقَاتِ وَالتَّشْدِيدِ فِيهَاChapter on What is Reported Regarding Taking Charity and Strictness in It
Hadith 679B
قَالَ مَالِك : الْأَمْرُ عِنْدَنَا أَنَّ كُلَّ مَنْ مَنَعَ فَرِيضَةً مِنْ فَرَائِضِ اللَّهِ عَزَّ وَجَلَّ ، فَلَمْ يَسْتَطِعِ الْمُسْلِمُونَ أَخْذَهَا ، كَانَ حَقًّا عَلَيْهِمْ جِهَادُهُ حَتَّى يَأْخُذُوهَا مِنْهُ
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that whoever withholds that which Allah has ordained and does not allow the Muslims to take it, then it is obligatory upon the Muslims to fight against that person until they take that right.
