Hadith 661

وَحَدَّثَنِي ، عَنْ وَحَدَّثَنِي ، عَنْ مَالِك ، عَنْ نَافِعٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ " كَانَ يُحَلِّي بَنَاتَهُ وَجَوَارِيَهُ الذَّهَبَ ، ثُمَّ لَا يُخْرِجُ مِنْ حُلِيِّهِنَّ الزَّكَاةَ "
It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to adorn his daughters and slave-girls with gold jewelry, and he did not take out zakat from their jewelry.
قَالَ مَالِك : لَيْسَ فِي اللُّؤْلُؤِ وَلَا فِي الْمِسْكِ وَلَا الْعَنْبَرِ زَكَاةٌ
Imam Malik, may Allah have mercy on him, said: There is no zakat on pearls, musk, and amber.
قَالَ مَالِك : مَنْ كَانَ عِنْدَهُ تِبْرٌ أَوْ حَلْيٌ مِنْ ذَهَبٍ أَوْ فِضَّةٍ ، لَا يُنْتَفَعُ بِهِ لِلُبْسٍ فَإِنَّ عَلَيْهِ فِيهِ الزَّكَاةَ فِي كُلِّ عَامٍ ، يُوزَنُ فَيُؤْخَذُ رُبُعُ عُشْرِهِ إِلَّا أَنْ يَنْقُصَ مِنْ وَزْنِ عِشْرِينَ دِينَارًا عَيْنًا أَوْ مِائَتَيْ دِرْهَمٍ ، فَإِنْ نَقَصَ مِنْ ذَلِكَ فَلَيْسَ فِيهِ زَكَاةٌ ، وَإِنَّمَا تَكُونُ فِيهِ الزَّكَاةُ إِذَا كَانَ إِنَّمَا يُمْسِكُهُ لِغَيْرِ اللُّبْسِ ، فَأَمَّا التِّبْرُ وَالْحُلِيُّ الْمَكْسُورُ الَّذِي يُرِيدُ أَهْلُهُ إِصْلَاحَهُ وَلُبْسَهُ ، فَإِنَّمَا هُوَ بِمَنْزِلَةِ الْمَتَاعِ الَّذِي يَكُونُ عِنْدَ أَهْلِهِ فَلَيْسَ عَلَى أَهْلِهِ فِيهِ زَكَاةٌ
Imam Malik, may Allah have mercy on him, said: Whoever possesses a lump of gold or silver and does not derive benefit from it, such as by wearing it, then its zakat is obligatory. Every year, one-fortieth part of it shall be taken. However, if it weighs less than twenty dinars or two hundred dirhams, then zakat is not obligatory. Rather, zakat is only due when it reaches the nisab amount, and no benefit is derived from it. But a lump intended to be made into jewelry, or broken jewelry intended to be repaired, is like household items; there is no zakat on it.
