قَالَ مَالِكٌ : أَنَّهُ سَمِعَ أَهْلَ الْعِلْمِ يَنْهَوْنَ أَنْ يُصَامَ الْيَوْمُ الَّذِي يُشَكُّ فِيهِ مِنْ شَعْبَانَ ، إِذَا نَوَى بِهِ صِيَامَ رَمَضَانَ. وَيَرَوْنَ أَنَّ عَلَى مَنْ صَامَهُ ، عَلَى غَيْرِ رُؤْيَةٍ ، ثُمَّ جَاءَ الثَّبَتُ أَنَّهُ مِنْ رَمَضَانَ ، أَنَّ عَلَيْهِ قَضَاءَهُ. وَلَا يَرَوْنَ بِصِيَامِهِ تَطَوُّعًا ، بَأْسًا ، قَالَ مالِكٌ : وَهَذَا الْأَمْرُ عِنْدَنَا وَالَّذِي أَدْرَكْتُ عَلَيْهِ أَهْلَ الْعِلْمِ بِبَلَدِنَا.
Imam Malik, may Allah have mercy on him, said: He heard from the people of knowledge that they used to prohibit fasting on the day of doubt in Sha'ban with the intention of Ramadan, and they used to say that if someone fasted in Sha'ban on the day of doubt without sighting the moon, and then a trustworthy person testified that day was of Ramadan, then making up that fast is obligatory upon him. However, there is no objection in keeping a voluntary fast. Imam Malik, may Allah have mercy on him, said that we found the people of knowledge in our city saying the same.
حَدَّثَنِي يَحْيَى ، عَنْ مَالِك ، عَنْ أَبِي النَّضْرِ مَوْلَى عُمَرَ بْنِ عُبَيْدِ اللَّهِ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهَا قَالَتْ : " كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَصُومُ حَتَّى نَقُولَ : لَا يُفْطِرُ ، وَيُفْطِرُ حَتَّى نَقُولَ : لَا يَصُومُ ، وَمَا رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اسْتَكْمَلَ صِيَامَ شَهْرٍ قَطُّ إِلَّا رَمَضَانَ ، وَمَا رَأَيْتُهُ فِي شَهْرٍ أَكْثَرَ صِيَامًا مِنْهُ فِي شَعْبَانَ "
It is narrated from Umm al-Mu'minin Sayyida Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) used to fast continuously until we would say: now he will not break the fast, and then he would break the fast continuously until we would say: now he will not fast. And I did not see the Messenger of Allah (peace and blessings be upon him) fast an entire month except for Ramadan, and he did not fast in any month more than he did in Sha'ban.
