... That is, this is a communal reservoir from which humans and animals continually come, turn by turn, to drink water. Their drinking does not render the water impure; therefore, whether or not the owner of the reservoir provides this detail is the same. If thirst is not quenched, life can be lost, so out of necessity and compulsion, even the leftover water from predatory animals has been deemed pure.
This narration is weak due to being disconnected (munqati‘). According to the Malikiyyah, as long as the color, smell, or taste of the water does not change, it remains pure and is not altered by any impurity. However, according to all other jurists and Imams, the distinction between a small and large quantity of water is considered, because the Prophet (sallallahu alayhi wa sallam) said:
«اِذَا كَانَ الْمَاءُ قلَتَيْنِ لَمْ يَحْمِلِ الْخَبَثَ»
“When water reaches the amount of two large containers (approximately five man), it does not accept impurity.”
[ترمذي: 67، اس كي سند صحيح هے]
Therefore, water that is five man or more will not become impure due to a small amount of impurity, unless its color, smell, or taste changes. However, water in a quantity less than this will become impure even with a small amount of impurity. ...
It should be noted that according to the Hanafiyyah, although the distinction between small and large quantity of water is considered, they define water less than a reservoir ten hand-spans wide and ten hand-spans long as a small quantity...
The aforementioned narration in «قلتين» is evidence against them, which Hafiz Ibn Hajar rahimahullah, Imam Hakim rahimahullah, Ibn Mandah rahimahullah, Ibn Khuzaymah rahimahullah, Ibn Hibban rahimahullah, Tahawi rahimahullah, Nawawi rahimahullah, and Dhahabi rahimahullah have declared authentic.
