وَحَدَّثَنِي، عَنْ مَالِك أَنَّهُ بَلَغَهُ، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، وَسَالِمَ بْنَ عَبْدِ اللَّهِ، وَعُرْوَةَ بْنَ الزُّبَيْرِ، كَانُوا يَقُولُونَ : " إِذَا سَرَقَ الْعَبْدُ الْآبِقُ مَا يَجِبُ فِيهِ الْقَطْعُ، قُطِعَ " .
Hazrat Qasim bin Muhammad, Salim bin Abdullah, and Urwah bin Zubair used to say: When a runaway slave steals to the extent for which the hand is to be cut off, then his hand will be cut off.
قَالَ مَالِك : وَذَلِكَ الْأَمْرُ الَّذِي لَا اخْتِلَافَ فِيهِ عِنْدَنَا، أَنَّ الْعَبْدَ الْآبِقَ إِذَا سَرَقَ مَا يَجِبُ فِيهِ الْقَطْعُ، قُطِعَ
Imam Malik, may Allah have mercy on him, said: In our view, there is no difference of opinion in this matter.
