حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
أَبِي الزِّنَادِ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، أَنَّ سَائِبَةً أَعْتَقَهُ بَعْضُ الْحُجَّاجِ، فَقَتَلَ ابْنَ رَجُلٍ مِنْ بَنِي عَائِذٍ، فَجَاءَ الْعَائِذِيٌ أَبُو الْمَقْتُولِ إِلَى عُمَرَ بْنِ الْخَطَّابِ يَطْلُبُ دِيَةَ ابْنِهِ، فَقَالَ
عُمَرُ :
" لَا دِيَةَ لَهُ "، فَقَالَ الْعَائِذِيٌ : أَرَأَيْْتَ لَوْ قَتَلَهُ ابْنِي ؟ فَقَال عُمَرُ : " إِذًا تُخْرِجُونَ دِيَتَهُ "، فَقَالَ : هُوَ إِذًا كَالْأرْقَمِ إِنْ يُتْرَكْ يَلْقَمْ وإِنْ يُقْتَلْ يَنْقَمْ
It is narrated from Sulayman bin Yasar that a Saibah (a slave woman freed by someone performing Hajj) killed the son of a man who was from Banu Aidh. The father of the slain came to Sayyiduna Umar (may Allah be pleased with him) to claim the blood money for his son. Sayyiduna Umar (may Allah be pleased with him) said: There is no blood money for him. The man said: If my son had killed the Saibah, what would you have ruled? Sayyiduna Umar (may Allah be pleased with him) said: Then you would have had to pay her blood money. The man said: Then what is a Saibah? She is like a spotted snake; if you let her go, she bites, and if you kill her, she takes revenge.
