بَابُ مَا جَاءَ فِي دِيَةِ جِرَاحِ الْعَبْدِChapter on What is Reported Regarding Compensation for Slave Injuries
Hadith 1520B4
قَالَ مَالِك، فِي الْعَبْدِ الْمُسْلِمِ يَجْرَحُ الْيَهُودِيَّ أَوِ النَّصْرَانِيَّ : إِنَّ سَيِّدَ الْعَبْدِ إِنْ شَاءَ أَنْ يَعْقِلَ عَنْهُ مَا قَدْ أَصَابَ فَعَلَ، أَوْ أَسْلَمَهُ فَيُبَاعُ فَيُعْطِي الْيَهُودِيَّ أَوِ النَّصْرَانِيَّ مِنْ ثَمَنِ الْعَبْدِ دِيَةَ جُرْحِهِ أَوْ ثَمَنَهُ كُلَّهُ إِنْ أَحَاطَ بِثَمَنِهِ، وَلَا يُعْطِي الْيَهُودِيَّ وَلَا النَّصْرَانِيَّ عَبْدًا مُسْلِمًا
Imam Malik, may Allah have mercy on him, said that if a Muslim slave injures a Jew or a Christian, then the master of the slave has the choice: either to pay the blood money or to hand over the slave. Then the slave will be sold and his blood money will be paid, but that slave cannot remain with the Jew or Christian (because it is not permissible for a Muslim to be subjugated by a disbeliever).
