Hadith 1509

عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ سَمِعَ سُلَيْمَانَ بْنَ يَسَارٍٍ، يَذْكُرُ أَنَّ الْمُوضِحَةَ فِي الْوَجْهِ مِثْلُ الْمُوضِحَةِ فِي الرَّأْسِ، إِلَّا أَنْ تَعِيبَ الْوَجْهَ فَيُزَادُ فِي عَقْلِهَا، مَا بَيْنَهَا وَبَيْنَ عَقْلِ نِصْفِ الْمُوضِحَةِ فِي الرَّأْسِ، فَيَكُونُ فِيهَا خَمْسَةٌ وَسَبْعُونَ دِينَارًا. ¤
It is narrated from Yahya bin Saeed that Sulaiman bin Yasar used to say that a wound on the face (muwaddiha) is like a wound on the head (muwaddiha), but if due to it there is any defect in the face, then the compensation (diyah) will be increased. If the wound on the head reaches half, then seventy-five (75) dinars will be obligatory for it.
قَالَ مَالِكٌ : وَالْأَمْرُ عِنْدَنَا أَنَّ فِي الْمُنَقِّلَةِ خَمْسَ عَشَرَةَ فَرِيضَةً. ¤
Imam Malik, may Allah have mercy on him, said: In our view, this ruling is based on consensus that in the case of "manqalah" there are fifteen camels.
قَالَ مَالِكٌ : وَالْمُنَقِّلَةُ الَّتِي يَطِيرُ فِرَاشُهَا مِنَ الْعَظْمِ، وَلَا تَخْرِقُ إِلَى الدِّمَاغِ، وَهِيَ تَكُونُ فِي الرَّأْسِ وَفِي الْوَجْهِ. ¤
Imam Malik, may Allah have mercy on him, said that "Manqalah" is the blow by which the bone is separated from its place but does not reach the brain, and it occurs in the head and the face.
قَالَ مَالِكٌ : الْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ الْمَأْمُومَةَ وَالْجَائِفَةَ لَيْسَ فِيهِمَا قَوَدٌ. وَقَدْ قَالَ ابْنُ شِهَابٍ : لَيْسَ فِي الْمَأْمُومَةِ قَوَدٌ. ¤
Imam Malik, may Allah have mercy on him, said that according to us, this ruling is based on consensus that there is no qisas (retaliation) in the case of ma'moomah and jaifah, and Ibn Shihab has also said the same that there is no qisas in ma'moomah.
قَالَ مَالِكٌ : الْأَمْرُ عِنْدَنَا أَنَّهُ لَيْسَ فِيمَا دُونَ الْمُوضِحَةِ مِنَ الشِّجَاجِ عَقْلٌ. حَتَّى تَبْلُغَ الْمُوضِحَةَ، وَإِنَّمَا الْعَقْلُ فِي الْمُوضِحَةِ فَمَا فَوْقَهَا. وَذَلِكَ أَنَّ رَسُولَ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ انْتَهَى إِلَى الْمُوضِحَةِ فِي كِتَابِهِ لِعَمْرِو بْنِ حَزْمٍ فَجَعَلَ فِيهَا خَمْسًا مِنَ الْإِبِلِ، وَلَمْ تَقْضِ الْأَئِمَّةُ فِي الْقَدِيمِ، وَلَا فِي الْحَدِيثِ فِيمَا دُونَ الْمُوضِحَةِ بِعَقْلٍ.
Imam Malik, may Allah have mercy on him, said: In our view, this ruling is based on consensus, that for a wound less than a muwaddiha, there is no blood money until it reaches the level of a muwaddiha. Rather, blood money is due for a muwaddiha or for what is greater than it, because the Messenger of Allah, peace and blessings be upon him, said in the hadith of Amr ibn Hazm: "For a muwaddiha, there are five camels." He did not mention anything less than that, nor did any Imam, whether in the past or present, give a ruling of blood money for less than a muwaddiha.
قَالَ مَالِكٌ : وَالْمَأْمُومَةُ مَا خَرَقَ الْعَظْمَ إِلَى الدِّمَاغِ، وَلَا تَكُونُ الْمَأْمُومَةُ إِلَّا فِي الرَّأْسِ، وَمَا يَصِلُ إِلَى الدِّمَاغِ إِذَا خَرَقَ الْعَظْمَ. ¤
Imam Malik, may Allah have mercy on him, said that "Mamoomah" is the blow that reaches the brain by breaking the bone, and "Mamoomah" occurs only in the head.
