بَابُ مَا جَاءَ فِي عَقْلِ الْعَيْنِ إِذَا ذَهَبَ بَصَرُهَاWhat is reported about blood money for the eye if sight is lost
Hadith 1508

قَالَ مَالِكٌ عَنْ شَتَرِ الْعَيْنِ، وَحِجَاجِ الْعَيْنِ : لَيْسَ فِي ذَلِكَ إِلَّا الِاجْتِهَادُ إِلَّا أَنْ يَنْقُصَ بَصَرُ الْعَيْنِ، فَيَكُونُ لَهُ بِقَدْرِ مَا نَقَصَ مِنْ بَصَرِ الْعَيْنِ. ¤
Imam Malik, may Allah have mercy on him, said that if someone cuts off another person's eyelid, or cuts the bony ring around the eye, then consideration will be given; if the eyesight is lost, then compensation equivalent to the damage will have to be paid.
قَالَ مَالِكٌ : الْأَمْرُ عِنْدَنَا فِي الْعَيْنِ الْقَائِمَةِ الْعَوْرَاءِ، إِذَا طَفِئَتْ، وَفِي الْيَدِ الشَّلَّاءِ إِذَا قُطِعَتْ، إِنَّهُ لَيْسَ فِي ذَلِكَ إِلَّا الِاجْتِهَادُ، وَلَيْسَ فِي ذَلِكَ عَقْلٌ مُسَمًّى.
Imam Malik, may Allah have mercy on him, said that if a person's eye was intact but had no sight, and someone destroyed it, or if a hand was paralyzed and someone cut it off, then blood money (diyah) will not be obligatory; rather, whatever is deemed appropriate by the opinion of the people will be given.
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، أَنَّ زَيْدَ بْنَ ثَابِتٍ ، كَانَ يَقُولُ فِي الْعَيْنِ الْقَائِمَةِ إِذَا طَفِئَتْ : " مِائَةُ دِينَارٍ " .
Hazrat Zaid bin Thabit used to say that when the eye remains but the sight is lost, then it will be one hundred dinars.
