بَابُ مَا جَاءَ فِي دِيَةِ الْعَمْدِ ، إِذَا قُبِلَتْ وَجِنَايَةِ الْمَجْنُونِWhat is reported about blood money for intentional murder if accepted, and the crime of the insane
Hadith 1497
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَنَّ مَرْوَانَ بْنَ الْحَكَمِ كَتَبَ إِلَى مُعَاوِيَةَ بْنِ أَبِي سُفْيَانَ : أَنَّهُ أُتِيَ بِمَجْنُونٍ قَتَلَ رَجُلًا، فَكَتَبَ إِلَيْهِ مُعَاوِيَةُ : " أَنِ اعْقِلْهُ وَلَا تُقِدْ مِنْهُ فَإِنَّهُ لَيْسَ عَلَى مَجْنُونٍ قَوَدٌ " .
It is narrated from Yahya bin Saeed that Marwan bin Hakam wrote to Muawiyah bin Abi Sufyan that a madman has been brought to me who has killed a person. Muawiyah wrote in reply that imprison him and do not take retribution from him, because retribution is not applicable to a madman.
