Hadith 1490

وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنِ الثِّقَةِ عِنْدَهُ، أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيَّبِ ، يَقُولُ : أَبَى عُمَرُ بْنُ الْخَطَّابِ " أَنْ يُوَرِّثَ أَحَدًا مِنَ الْأَعَاجِمِ، إِلَّا أَحَدًا وُلِدَ فِي الْعَرَبِ " .
Hazrat Saeed bin Musayyib used to say that Sayyiduna Umar bin Khattab (may Allah be pleased with him) refused to grant inheritance of people from foreign lands to the people of his own country, except for those who were born in Arabia.
قَالَ مَالِكٌ : وَكَذَلِكَ كُلُّ مَنْ لَا يَرِثُ إِذَا لَمْ يَكُنْ دُونَهُ وَارِثٌ، فَإِنَّهُ لَا يَحْجُبُ أَحَدًا عَنْ مِيرَاثِهِ
Imam Malik, may Allah have mercy on him, said that according to us this ruling is based on consensus and there is no difference of opinion in it: a Muslim cannot inherit from a disbeliever due to any relationship, whether it is by lineage, wala', or kinship, nor can he deprive anyone of his inheritance.

Imam Malik, may Allah have mercy on him, said that likewise, whoever does not inherit cannot deprive another of inheritance.
قَالَ مَالِكٌ : وَإِنْ جَاءَتِ امْرَأَةٌ حَامِلٌ مِنْ أَرْضِ الْعَدُوِّ، فَوَضَعَتْهُ فِي أَرْضِ الْعَرَبِ، فَهُوَ وَلَدُهَا، يَرِثُهَا إِنْ مَاتَتْ، وَتَرِثُهُ إِنْ مَاتَ، مِيرَاثَهَا فِي كِتَابِ اللَّهِ . قَالَ مَالِكٌ : الْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا، وَالسُّنَّةُ الَّتِي لَا اخْتِلَافَ فِيهَا، وَالَّذِي أَدْرَكْتُ عَلَيْهِ أَهْلَ الْعِلْمِ بِبَلَدِنَا : أَنَّهُ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ بِقَرَابَةٍ، وَلَا وَلَاءٍ، وَلَا رَحِمٍ، وَلَا يَحْجُبُ أَحَدًا عَنْ مِيرَاثِهِ .
Imam Malik, may Allah have mercy on him, said that if a woman comes from the land of the disbelievers while pregnant and resides in Arabia, and gives birth there, then she will inherit from her son and the son will inherit from her.
