Hadith 1474B2

قَالَ : وَسَمِعْتُ مَالِكًا يَقُولُ، فِي الْعَبْدِ يَكُونُ بَعْضُهُ حُرًّا وَبَعْضُهُ مُسْتَرَقًّا : إِنَّهُ يُوقَفُ مَالُهُ بِيَدِهِ، وَلَيْسَ لَهُ أَنْ يُحْدِثَ فِيهِ شَيْئًا، وَلَكِنَّهُ يَأْكُلُ فِيهِ وَيَكْتَسِي بِالْمَعْرُوفِ، فَإِذَا هَلَكَ فَمَالُهُ لِلَّذِي بَقِيَ لَهُ فِيهِ الرِّقُّ .
Imam Malik, may Allah have mercy on him, said that if a slave is partially free and partially still owned (a slave), then his wealth will remain with him; nothing new can be done with it, rather, he may eat and drink from it as needed. Then, when he dies, that wealth will go to the one whose ownership remained.
