قَالَ : وَسَمِعْتُ مَالِكًا، يَقُولُ : مَنِ اسْتَعَانَ عَبْدًا بِغَيْرِ إِذْنِ سَيِّدِهِ فِي شَيْءٍ لَهُ بَالٌ، وَلِمِثْلِهِ إِجَارَةٌ فَهُوَ ضَامِنٌ لِمَا أَصَابَ الْعَبْدَ إِنْ أُصِيبَ الْعَبْدُ بِشَيْءٍ، وَإِنْ سَلِمَ الْعَبْدُ فَطَلَبَ سَيِّدُهُ إِجَارَتَهُ لِمَا عَمِلَ فَذَلِكَ لِسَيِّدِهِ، وَهُوَ الْأَمْرُ عِنْدَنَا .
Imam Malik, may Allah have mercy on him, said that if a person takes help from another's slave in a major task without the owner's permission, for which it is necessary to hire a servant or call a laborer, and the slave suffers any defect because of performing that work, then liability will be obligatory upon him. And if the slave remains safe and sound and his master demands wages, then wages will have to be paid.
