حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
ابْنِ شِهَابٍ ، عَنْ
حَرَامِ بْنِ سَعْدِ بْنِ مُحَيِّصَةَ ، أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْ فِيهِ " فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ
عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ، وَأَنَّ مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا "
It is narrated from Haram bin Sa'd Muhayyisah that the camel of Sayyiduna Bara' bin 'Azib (may Allah be pleased with him) entered a garden and caused damage, so the Messenger of Allah (peace and blessings be upon him) ordered that "the protection of the garden during the day is the responsibility of the owner of the garden, but if at night an animal enters the garden and causes damage, then the liability will be upon the owner of the animal."
