بَابُ مَا جَاءَ فِي الْمُسَاقَاةِChapter on what is reported regarding musaqat (sharecropping)
Hadith 1401
حَدَّثَنَا يَحْيَى، عَنْ مَالِك، عَنِ ابْنِ شِهَابٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ لِيَهُودِ خَيْبَرَ يَوْمَ افْتَتَحَ خَيْبَرَ : " أُقِرُّكُمْ فِيهَا مَا أَقَرَّكُمُ اللَّهُ عَزَّ وَجَلَّ، عَلَى أَنَّ الثَّمَرَ بَيْنَنَا وَبَيْنَكُمْ " . قَالَ : فَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَبْعَثُ عَبْدَ اللَّهِ بْنَ رَوَاحَةَ فَيَخْرُصُ بَيْنَهُ وَبَيْنَهُمْ، ثُمَّ يَقُولُ : إِنْ شِئْتُمْ فَلَكُمْ، وَإِنْ شِئْتُمْ فَلِي فَكَانُوا يَأْخُذُونَهُ
It is narrated from Sa'id bin al-Musayyib that the Messenger of Allah, peace and blessings be upon him, said to the Jews of Khaybar on the day Khaybar was conquered: "I will let you remain on what Allah has given you, on the condition that the fruits produced here will be shared between us and you." So the Messenger of Allah, peace and blessings be upon him, used to send Abdullah bin Rawahah, who would look at the trees and estimate their fruits, and say: If you wish, you may take these fruits, and give us half of what has been estimated, or we will give you half of the fruits according to this estimate. The Jews themselves used to take the fruits.
