قَالَ مَالِكٌ : وَإِذَا بَاعَ رَجُلٌ سِلْعَةً قَامَتْ عَلَيْهِ بِمِائَةِ دِينَارٍ، لِلْعَشَرَةِ أَحَدَ عَشَرَ، ثُمَّ جَاءَهُ بَعْدَ ذَلِكَ أَنَّهَا قَامَتْ عَلَيْهِ بِتِسْعِينَ دِينَارًا، وَقَدْ فَاتَتِ السِّلْعَةُ خُيِّرَ الْبَائِعُ، فَإِنْ أَحَبَّ فَلَهُ قِيمَةُ سِلْعَتِهِ يَوْمَ قُبِضَتْ مِنْهُ، إِلَّا أَنْ تَكُونَ الْقِيمَةُ أَكْثَرَ مِنَ الثَّمَنِ الَّذِي وَجَبَ لَهُ بِهِ الْبَيْعُ أَوَّلَ يَوْمٍ، فَلَا يَكُونُ لَهُ أَكْثَرُ مِنْ ذَلِكَ، وَذَلِكَ مِائَةُ دِينَارٍ وَعَشْرَةُ دَنَانِيرَ، وَإِنْ أَحَبَّ ضُرِبَ لَهُ الرِّبْحُ عَلَى التِّسْعِينَ، إِلَّا أَنْ يَكُونَ الَّذِي بَلَغَتْ سِلْعَتُهُ مِنَ الثَّمَنِ أَقَلَّ مِنَ الْقِيمَةِ فَيُخَيَّرُ فِي الَّذِي بَلَغَتْ سِلْعَتُهُ وَفِي رَأْسِ مَالِهِ وَرِبْحِهِ وَذَلِكَ تِسْعَةٌ وَتِسْعُونَ دِينَارًا. ¤
Imam Malik, may Allah have mercy on him, said that if a person sold his item, which had cost him one hundred dinars, at a profit of ten percent, and then it was found out that the item had actually cost ninety dinars, and that item was lost while with the buyer, then the seller will have the option to either take the market price of that item, the price on the day the item came into the possession of the buyer, but in the case where the market price is more than the price that was originally agreed upon, that is, more than one hundred and ten dinars, then the seller will not get more than one hundred and ten dinars, and if he wishes, he can take ninety-nine dinars by adding profit to ninety dinars accordingly, but in the case where this price is less than the value, then the seller will have the option.
