بَابُ بَيْعِ الْمُرَابَحَةِSale by Profit Margin (Murabaha)
Hadith 1377Q3
قَالَ مَالِكٌ : فِي الرَّجُلِ يَشْتَرِي الْمَتَاعَ بِالذَّهَبِ أَوْ بِالْوَرِقِ، وَالصَّرْفُ يَوْمَ اشْتَرَاهُ عَشَرَةُ دَرَاهِمَ بِدِينَارٍ، فَيَقْدَمُ بِهِ بَلَدًا فَيَبِيعُهُ مُرَابَحَةً، أَوْ يَبِيعُهُ حَيْثُ اشْتَرَاهُ مُرَابَحَةً عَلَى صَرْفِ ذَلِكَ الْيَوْمِ الَّذِي بَاعَهُ فِيهِ، فَإِنَّهُ إِنْ كَانَ ابْتَاعَهُ بِدَرَاهِمَ، وَبَاعَهُ بِدَنَانِيرَ، أَوِ ابْتَاعَهُ بِدَنَانِيرَ، وَبَاعَهُ بِدَرَاهِمَ، وَكَانَ الْمَتَاعُ لَمْ يَفُتْ، فَالْمُبْتَاعُ بِالْخِيَارِ إِنْ شَاءَ أَخَذَهُ، وَإِنْ شَاءَ تَرَكَهُ، فَإِنْ فَاتَ الْمَتَاعُ كَانَ لِلْمُشْتَرِي بِالثَّمَنِ الَّذِي ابْتَاعَهُ بِهِ الْبَائِعُ، وَيُحْسَبُ لِلْبَائِعِ الرِّبْحُ عَلَى مَا اشْتَرَاهُ بِهِ عَلَى مَا رَبَّحَهُ الْمُبْتَاعُ. ¤
Imam Malik, may Allah have mercy on him, said that if a person bought some goods in exchange for gold or silver, and on that day the rate of silver to gold was such that ten dirhams equaled one dinar, then the buyer took this merchandise to another city, and wanted to sell it there as murabaha at the same rate of gold and silver as it was on that day. If he had bought it in exchange for dirhams and sold it for dinars, or bought it for dinars and sold it for dirhams, and the goods are still present and not destroyed, then the buyer has the choice to take it or not. And if the goods have been destroyed, then the buyer will be given the price for which the seller had bought it, after calculating the profit, from the buyer.
