قَالَ مَالِكٌ : الْأَمْرُ عِنْدَنَا فِي الْقَوْمِ يَشْتَرُونَ السِّلْعَةَ الْبَزَّ، أَوِ الرَّقِيقَ. فَيَسْمَعُ بِهِ الرَّجُلُ فَيَقُولُ لِرَجُلٍ مِنْهُمُ الْبَزُّ الَّذِي اشْتَرَيْتَ مِنْ فُلَانٍ، قَدْ بَلَغَتْنِي صِفَتُهُ وَأَمْرُهُ، فَهَلْ لَكَ أَنْ أُرْبِحَكَ فِي نَصِيبِكَ كَذَا وَكَذَا، فَيَقُولُ : نَعَمْ فَيُرْبِحُهُ، وَيَكُونُ شَرِيكًا لِلْقَوْمِ مَكَانَهُ، فَإِذَا نَظَرَ إِلَيْهِ رَآهُ قَبِيحًا وَاسْتَغْلَاهُ، قَالَ مَالِكٌ : ذَلِكَ لَازِمٌ لَهُ، وَلَا خِيَارَ لَهُ فِيهِ، إِذَا كَانَ ابْتَاعَهُ عَلَى بَرْنَامَجٍ وَصِفَةٍ مَعْلُومَةٍ. ¤
Imam Malik, may Allah have mercy on him, said that if several people together purchase some goods, and then a person says to one of them: "The goods you have bought, I have heard about their qualities, so sell me your share at such and such profit, and I will become a partner with those people in your place." And if he agrees, then after that, when he sees the goods and finds them bad and expensive, he will not have the option (to withdraw); he will have to take them, as long as the goods were sold to him based on the description and the qualities had been explained.
