بَابُ بَيْعِ الْخِيَارِSale with Option (Khiyar)

قَالَ مَالِكٌ : الْأَمْرُ عِنْدَنَا فِي الْقَوْمِ يَشْتَرُونَ السِّلْعَةَ الْبَزَّ، أَوِ الرَّقِيقَ. فَيَسْمَعُ بِهِ الرَّجُلُ فَيَقُولُ لِرَجُلٍ مِنْهُمُ الْبَزُّ الَّذِي اشْتَرَيْتَ مِنْ فُلَانٍ، قَدْ بَلَغَتْنِي صِفَتُهُ وَأَمْرُهُ، فَهَلْ لَكَ أَنْ أُرْبِحَكَ فِي نَصِيبِكَ كَذَا وَكَذَا، فَيَقُولُ : نَعَمْ فَيُرْبِحُهُ، وَيَكُونُ شَرِيكًا لِلْقَوْمِ مَكَانَهُ، فَإِذَا نَظَرَ إِلَيْهِ رَآهُ قَبِيحًا وَاسْتَغْلَاهُ، قَالَ مَالِكٌ : ذَلِكَ لَازِمٌ لَهُ، وَلَا خِيَارَ لَهُ فِيهِ، إِذَا كَانَ ابْتَاعَهُ عَلَى بَرْنَامَجٍ وَصِفَةٍ مَعْلُومَةٍ. ¤
Imam Malik, may Allah have mercy on him, said that if several people together purchase some goods, and then a person says to one of them: "The goods you have bought, I have heard about their qualities, so sell me your share at such and such profit, and I will become a partner with those people in your place." And if he agrees, then after that, when he sees the goods and finds them bad and expensive, he will not have the option (to withdraw); he will have to take them, as long as the goods were sold to him based on the description and the qualities had been explained.
قَالَ مَالِكٌ : فِي الرَّجُلِ يَقْدَمُ لَهُ أَصْنَافٌ مِنَ الْبَزِّ، وَيَحْضُرُهُ السُّوَّامُ، وَيَقْرَأُ عَلَيْهِمْ بَرْنَامَجَهُ، وَيَقُولُ : فِي كُلِّ عِدْلٍ كَذَا وَكَذَا مِلْحَفَةً بَصْرِيَّةً، وَكَذَا وَكَذَا رَيْطَةً سَابِرِيَّةً ذَرْعُهَا كَذَا وَكَذَا، وَيُسَمِّي لَهُمْ أَصْنَافًا مِنَ الْبَزِّ بِأَجْنَاسِهِ، وَيَقُولُ : اشْتَرُوا مِنِّي عَلَى هَذِهِ الصِّفَةِ، فَيَشْتَرُونَ الْأَعْدَالَ عَلَى مَا وَصَفَ لَهُمْ ثُمَّ يَفْتَحُونَهَا فَيَسْتَغْلُونَهَا وَيَنْدَمُونَ، قَالَ مَالِكٌ : ذَلِكَ لَازِمٌ لَهُمْ إِذَا كَانَ مُوَافِقًا لِلْبَرْنَامَجِ الَّذِي بَاعَهُمْ عَلَيْهِ. قَالَ مَالِكٌ : وَهَذَا الْأَمْرُ الَّذِي لَمْ يَزَلْ عَلَيْهِ النَّاسُ عِنْدَنَا يُجِيزُونَهُ بَيْنَهُمْ، إِذَا كَانَ الْمَتَاعُ مُوَافِقًا لِلْبَرْنَامَجِ وَلَمْ يَكُنْ مُخَالِفًا لَهُ.
Imam Malik, may Allah have mercy on him, said that a person received bundles of various clothes, and he sold those bundles according to a description. When people opened the goods and saw them, they found them expensive and regretted it. In this case, they must take the goods, as long as they are according to the description.
قَالَ مَالِك : وَلَيْسَ لِهَذَا عِنْدَنَا حَدٌّ مَعْرُوفٌ، وَلَا أَمْرٌ مَعْمُولٌ بِهِ فِيهِ
Imam Malik, may Allah have mercy on him, said: In our view, there is no fixed period for the option (of rescinding a sale).
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ : " الْمُتَبَايِعَانِ كُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ " .
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "The seller and the buyer both have the option (to cancel the transaction) as long as they have not separated, except in the sale in which the option (of rescission) has been stipulated."
