قَالَ مَالِكٌ : وَلَا يَحِلُّ بَيْعُ الطَّعَامِ قَبْلَ أَنْ يُسْتَوْفَى لِنَهْيِ رَسُولِ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ، غَيْرَ أَنَّ أَهْلَ الْعِلْمِ قَدِ اجْتَمَعُوا عَلَى أَنَّهُ لَا بَأْسَ بِالشِّرْكِ وَالتَّوْلِيَةِ وَالْإِقَالَةِ فِي الطَّعَامِ وَغَيْرِهِ. ¤
Imam Malik, may Allah have mercy on him, said that the sale of grain before taking possession is prohibited, but the people of knowledge have consensus that partnership, tawliyah, and iqalah are permissible in grain and similar things.
