بَابُ مَا جَاءَ فِي مَالِ الْمَمْلُوكِ إِذَا بِيعِChapter on what is reported regarding the property of a slave when sold
Hadith 1304
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ ، قَالَ : " مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَهُ الْمُبْتَاعُ " .
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them), Sayyiduna Umar (may Allah be pleased with him) said: Whoever sells a slave and the slave possesses some property, then that property will go to the seller. Except when the buyer stipulates that he will take the property.
