وَقَالَ مَالِك، فِي الْمُدَبَّرِ إِذَا جَرَحَ رَجُلًا فَأَسْلَمَهُ سَيِّدُهُ إِلَى الْمَجْرُوحِ، ثُمَّ هَلَكَ سَيِّدُهُ وَعَلَيْهِ دَيْنٌ وَلَمْ يَتْرُكْ مَالًا غَيْرَهُ، فَقَالَ الْوَرَثَةُ : نَحْنُ نُسَلِّمُهُ إِلَى صَاحِبِ الْجُرْحِ، وَقَالَ صَاحِبُ الدَّيْنِ : أَنَا أَزِيدُ عَلَى ذَلِكَ : إِنَّهُ إِذَا زَادَ الْغَرِيمُ شَيْئًا فَهُوَ أَوْلَى بِهِ، وَيُحَطُّ عَنِ الَّذِي عَلَيْهِ الدَّيْنُ قَدْرُ مَا زَادَ الْغَرِيمُ عَلَى دِيَةِ الْجَرْحِ، فَإِنْ لَمْ يَزِدْ شَيْئًا لَمْ يَأْخُذْ الْعَبْدَ .
Imam Malik, may Allah have mercy on him, said that if a mudabbar (a slave set free after the master's death) injures someone and the master hands him over to the injured party, then the master dies in debt and leaves nothing except the mudabbar, and the heirs say, "We hand over the mudabbar to the injured party," and the creditor says, "If the mudabbar is given to me, I will pay more than the blood money," then in this case the mudabbar will be handed over to the creditor, and the amount by which the creditor pays more than the blood money will be deducted from the master's debt. If the creditor does not pay more than the blood money, then he cannot take the mudabbar.
