قَالَ مَالِك : فَإِنْ كَانَ فِي ثُلُثِ الْمَيِّتِ مَا يَعْتِقُ فِيهِ الْمُدَبَّرُ كُلُّهُ، عَتَقَ وَكَانَ عَقْلُ جِنَايَتِهِ دَيْنًا عَلَيْهِ يُتَّبَعُ بِهِ بَعْدَ عِتْقِهِ، وَإِنْ كَانَ ذَلِكَ الْعَقْلُ الدِّيَةَ كَامِلَةً، وَذَلِكَ إِذَا لَمْ يَكُنْ عَلَى سَيِّدِهِ دَيْنٌ
Imam Malik, may Allah have mercy on him, said that if a mudabbar can be freed from one-third of the wealth, then he will be freed, and the blood money for the wound will remain as a debt upon him even if it is the full blood money. After his freedom, he will be held accountable for it when the master has no debt upon him.
