بَابُ الْوَصِيَّةِ فِي الْمُكَاتَبِChapter on Bequest Regarding a Mukatab
Hadith 1300Q21
قَالَ مَالِكٌ : إِذَا وَضَعَ الرَّجُلُ عَنْ مُكَاتَبِهِ عِنْدَ مَوْتِهِ أَلْفَ دِرْهَمٍ مِنْ عَشَرَةِ آلَافِ دِرْهَمٍ وَلَمْ يُسَمِّ أَنَّهَا مِنْ أَوَّلِ كِتَابَتِهِ أَوْ مِنْ آخِرِهَا. وُضِعَ عَنْهُ مِنْ كُلِّ نَجْمٍ عُشْرُهُ. ¤
Imam Malik, may Allah have mercy on him, said that if a person made a bequest that a certain slave of his is free and another should be made a mukatab (contracted for freedom), and the one-third of the wealth is not sufficient for both, then freeing (the slave) will take precedence over the mukatabah (contract).
